In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 1st Floor of the Courthouse, in the Magistrate John P. O'Neill's Courtroom, Courtroom C in Ravenna, in the above named County, on Monday, November 29, 2010, at 11:00 A.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Randolph to-wit:

Situated in the Township of Randolph, County of Portage and State of Ohio:

And known as being part of Lot No. 78 in said Randolph Township, Ohio and described as follows:

Beginning at the Southeast corner of said Lot No. 78, which is also the intersection of the centerlines of C.H. 69 and T. H. 40; thence Westerly along the centerline of T.H. 40, 556.10 feet to a point; thence Northerly a distance of 318.20 feet to a point in the South line of the lands of George F. McCabe; thence Easterly along the South line of George F. McCabe's land to the East line of said Lot No. 78 and the center line of C.H. 62, a distance of approximately 556.10 feet; thence Southerly along the center line of C.H. 69 to the place of beginning, containing 4.00 acres of land, more or less.

Excepting therefrom the following described parcels:

Situated in the Township of Randolph, County of Portage and State of Ohio:

And known as being part of Township Lot 78 and further described as follows:

Beginning at an iron pin at the Southeast corner of Lot 78; thence N. 2 deg. 29' 30" E., 228.20 feet along the centerline of Hartville Road; C.H. 69 and East line of Lot 78 to the point of true beginning; thence N. 87 deg. 15' 30" W., passing over an iron pin 25 feet from the centerline, 200 feet to an iron pin; thence N. 2 deg. 29' 30" E., 115 feet to an iron pin; thence S. 07 deg. 15' 30" E., 200 feet to the center line of Hartville Road and the East line of Lot 78, iron pin set 25 feet from centerline; thence S. 2 deg. 29' 30" W., along the lot line and centerline 115 feet to the point of true beginning and containing 0.528 acres, as surveyed by Dana D. Fawley, Registered Surveyor No. 4839, June 20, 1962, be the same more or less, but subject to all legal highways.

Exception No. 2:

Situated in the Township of Randolph, County of Portage and State of Ohio:

Known as being part of Lot No. 78 in said Randolph Township, bounded and described as follows:

Beginning at a point in the centerline of C.H. 69, which point is North approximately 310.28 feet from the intersection of the center lines of C.H. 69 and T. H. 40 and which point also marks the Southeast corner of land now owned by George T. McCabe, now owned by S. Arkey and the true place of beginning for this description; thence Southerly along the center line of C.H. 69, a distance of 75.0 feet to a point; thence Westerly and parallel to said McCabe's South line a distance of 200.00 feet to a point; thence Northerly and parallel to the center line of C.H. 69, a distance of 75.0 feet to a point in said McCabe's South line; thence Easterly along McCabe's South line, a distance of 200.00 feet to the place of beginning and containing 0.344 acres of land.

Exception No. 3:

Situated in the Township of Randolph, County of Portage and State of Ohio:

And known as being part of Township Lot No. 78 and further described as follows:

Beginning at an iron pipe in the Southeast corner of Lot No. 78; thence N. 07 deg. 15' 30" West along the South line of Lot No. 78 and the centerline of Luli Road (T.H. 40) 200 feet to a point; thence North 2 deg. 29' 30" parallel to the centerline of Hartville Road (C.H. 69) 128.28 feet to an iron pipe; thence South 87 deg. 15' 20" East, 200.00 feet to the centerline of Hartville Road (C.H. 69) and the East line of Lot 78 and passing over an iron pipe set 25 feet from said centerline; thence South 2 deg. 29' 30" West along the lot line and the centerline of Hartville Road, 120.28 feet to the place of beginning and containing .5889 acres of land, more or less, but subject to all legal highways, including twenty-five (25) feet of additional right of way on Hartville Road, as acquired June 2, 1939 as surveyed by Dana D. Fawley, Professional Surveyor No. 4839, July 23, 1962 and described September 5, 1969.

Exception No. 4:

Located in Lot 78, Randolph Township, Portage County, Ohio and being further described as follows:

Beginning at an iron pin found at the S.E. corner of Lot 78 on the intersection of the centerlines of C.H. 69, Hartville Road and T. H. 40, Luli Road; thence N. 87 deg. 15' 30' W., a distance of 398.00 feet along the South line of Lot 78 to an iron railroad spike set which is the true place of beginning; thence continuing N. 87 deg. 15' 30" W., a distance of 156.10 feet along said lot line to an iron pin found at the S.W. corner of this Grantor; thence N. 2 deg. 29' 30" E., a distance of 318.20 feet to an iron pin found at the NW corner of this Grantor; thence S. 87 deg. 15' 30" E., a distance of 136.86 feet along the North line of this Grantor to an iron rod set; thence S. 2 deg. 29' 30" W., a distance of 234.50 feet to an iron rod set; thence S. 10 deg. 15' 30" E., a distance of 96.25 feet to the true place of beginning and containing 1.022 acres of land as surveyed by Terrance E. Hohnhorst, Registered Professional Land Surveyor No. 5065 in October, 1976.

Leaving to be conveyed 1.5171 acres of land.

Said Premises Located at 3391 Luli Rd., Mogadore, OH 44260.

Said Premises Appraised at $50,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid is required from third party purchasers at the time of sale. Conveyance and Recording Fees are required from all bidders at the time of sale. The balance of the purchase price shall be paid within thirty (30) days after the date the confirmation is filed with the clerk.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
