In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 1st Floor of the Courthouse, in the Magistrate John P. O'Neill's Courtroom, Courtroom C in Ravenna, in the above named County, on Monday, September 13, 2010, at 11:00 A.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Rootstown to-wit:

PARCEL ONE:

Situated in the Township of Rootstown, County of Portage and State of Ohio:

Situated in the township, county and state aforesaid and known as being Lots Nos. Four (4), Five (5) and Thirty-two (32) in Block F of the Ravenna Building Company's Allotment, Section 1, in Large Lot No. 20 of said Rootstown Township, as the same is platted, numbered and recorded in Plat Book 4, Page 14, Portage County Records of Plats.

EXCEPTING THEREFROM the following described parcels:

EXCEPTION ONE:

Situated in the Township of Rootstown, County of Portage and State of Ohio, and in Section Lot 20, Town 2-N, Range 8-W and bounded and described as follows:

PARCEL NO. 29 WL

Being a parcel of land lying on the right & left sides of the centerline of a survey, made by the Department of Highways, and recorded in Book 17, Page 72 of the records of Portage County and being located within the following described points in the boundary thereof:

Known as being all of Lots 29 and 30 and a part of Lots 31 and 32 in the Ravenna Building Companies Allotment, Block F, Section 1 as recorded in Plat Book 4, Page 14, of the Portage County Records of Plats and being more fully described as follows:

Beginning at an angle point in the Grantor's Southwest property corner, same being the Southwest corner of said Lot 29; thence N. 00 deg. 49' 15" E., along the Grantor's Westerly property line and the Westerly line of said Lots 29 and 30 a distance of 60.00 feet to an angle point in the proposed Westerly limited access right of way line of S.R. 5; thence N. 48 deg. 26' 51" E., along said proposed limited access right of way line passing through Lots 31 and 32, a distance of 87.93 feet to an angle point in the Grantor's Northerly property line and the Northerly line of said Lot 32; thence S. 88 deg. 30' 45" E., along said Northerly property line and lot line a distance of 65.00 feet to an angle point in the Grantor's Northeast property corner and the Northeast corner of said Lot 32; thence S. 00 deg. 49' 15" W., along the Grantor's Easterly property line and the Easterly line of said Lots 32, 31, 30 and 29 a distance of 120.00 feet to an angle point in the Grantor's Southeast property corner and the Southeast corner of said Lot 29; thence N. 88 deg. 30' 45" W., along the Grantor's Southerly property line and the Southerly line of said Lot 29, a distance of 130.00 feet to the point of beginning, containing 13,645.9 square feet of land, more or less. Description for the above parcel is based on a survey made by Clifton M. Newhall, Registered Suroveyor No. 2684.

EXCEPTION TWO:

Situated in the Township of Rootstown, County of Portage and State of Ohio, and in Section Lots 31 and 32, Town 2 North, Range 8 West and bounded and described as follows:

PARCEL NO. 3 WL

Being a parcel of land lying on the left side of the centerline of a survey, made by the Department of Transportation and recorded in Book 17, Page 72 of the records of Portage County and being located within the following described points in the boundary thereof:

Being a parcel of land situated in the County of Portage, State of Ohio, and known as being a part of Lots 31 and 32 in Block "F" of the Ravenna Building Companies Allotment of part of Original Lot 20 in the Township of Rootstown as shown by the recorded plat in Plat Book 4, Page 14 of the Portage County Records. Said parcel is further bounded and described as follows:

Beginning at a monument on the existing center line of right-of-way of State Route 44, said monument being 6.45 feet right of Station 439+48.49 on the center line of State Route 5 and is formerly the Southwesterly corner of Block "F" in the aforementioned Ravenna Building Companies Allotment; thence North 0 deg. 49' 15" East, along the existing center line of right-of-way of State Route 44, a distance of 11.32 feet to a point therein at the intersection of said center line of right-of-way with the center line of State Route 5; thence North 38 deg. 15' 00" East, along the existing center line of State Route 5, a distance of 473.24 feet to a point therein; thence North 51 deg. 45' 00" West, at right angles to said existing center line of State Route 5, a distance of 61.23 feet to a point on the existing Westerly limited access line at the most Northeasterly corner of Lot 32 in the aforementioned Ravenna Building Companies Allotment, said point being 61.23 feet left of Station 444+28.42 on the existing center line of State Route 5 and is the true place of beginning for the parcel herein described; thence South 48 deg. 26' 51" West, along the existing Westerly limited access line of State Route 5, a distance of 87.93 feet to a point therein at the most Southwesterly corner of Lot 31; thence North 0 deg. 49' 15" East along the Westerly line of Lot 31, a distance of 30.00 feet to a point on the proposed Westerly limited access line at the most Northwesterly corner of said Lot 31; thence South 88 deg. 30' 45" East, along the proposed Westerly limited access line and the Northerly line of Lot 31, a distance of 15.00 feet to a point therein; thence North 31 deg. 10' 48" East, continuing along the proposed Westerly limited access line, a distance of 34.55 feet to a point on the Northerly line of Lot 32; thence South 88 deg. 30' 45" East, along said Northerly line of Lot 32, a distance of 32.50 feet to the true place of beginning and containing 0.028 acres of land, be the same more or less, but subject to all legal highways and easements of records. The above described area includes:

a) 0.011 acres of land in Auditor's Parcel Number 32-020-12-00-082-000 which contains 0.011 acres and

b) 0.017 acres of land in Auditor's Parcel Number 32-020-12-00-083-000 which containing 0.034 acres.

Grantor claims title by instrument of record in Deed Book 928, Page 296 of the Portage County Records.

"Basis of Bearing" Right of way plan development has been established by utilizing information from the POR-5-8-98. Right of way plan dated 1965. Center line plat for said project is recorded in Volume 17, Page 72 of the Portage County Records. The above description is based on a field survey conducted by or under the supervision of Joseph R. Ciuni, Registered Surveyor No. 7394 in 1993 and 1994.

PARCEL TWO:

Situated in the Township of Rootstown, County of Portage and State of Ohio:

And known as being Lots #6 & #7 in Block F of the Ravenna Building Companies Allotment, Section One in Large Lot #20 of Rootstown Township, Portage County, Ohio, as same is platted, numbered and recorded in Plat Book #4, Page 14 of Portage County Records. Said lots being thirty (30) feet front on Randolph Road and one hundred forty feet in depth.

EXCEPTING THEREFROM:

Known as being a part of Lot 7 in Block F in the Ravenna Building Company's Allotment, Section 1, as recorded in Plat Book 4, Page 14 of the Portage County Records of Plats and being more fully described as follows:

Beginning at an angle point in the Grantors Southeast property corner, same being the Southeast corner of said Lot 7; thence N. 88 deg. 30' 45" W., along the Grantor's Southerly property line and the Southerly line of said Lot 7, a distance of 32.47 feet to an angle point in the proposed Westerly limited access, right of way line of S.R. 5; thence N .48 deg. 26' 51" E., along said proposed limited access, right of way line of 43.95 feet to an angle point in the Grantors Northeast property corner and the Northeast corner of said Lot 7; thence S. 00 deg. 49' 15" W., along the Grantors Easterly property line and the Easterly line of said Lot 7, a distance of 30.00 feet to the point of beginning, containing 487 square feet of land, more or less.

Said Premises Located at 4760 S. Prospect St., Ravenna, OH 44266.

Said Premises Appraised at $90,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid is required from third party purchasers at the time of sale. Conveyance and Recording Fees are required from all bidders at the time of sale. The balance of the purchase price shall be paid within thirty (30) days after the date the confirmation is filed with the clerk.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
