In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 1st Floor of the Courthouse, in the Magistrate John P. O'Neill's Courtroom, Courtroom C in Ravenna, in the above named County, on Monday, August 30, 2010, at 11:00 A.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Brimfield to-wit:

PARCEL ONE:

Situated in the Township of Brimfield, County of Portage and State of Ohio and known as being part of Lot 22 in Brimfield Township and further described as follows:

Beginning at a point in the centerline of Howe Road and the North line of Lot 22 and being West 837.34 feet from an iron bar at the Northeast corner of Lot 22; thence South 240.00 feet along the West line of E. & M. Napier to an iron pipe; thence East 150.00 feet to an iron pipe at Napier's Southeast corner; thence South 100.00 feet to an iron pipe; thence West 370.00 feet to an iron pipe; thence North 120.00 feet to the Grantee's Southwest corner; thence East 200.00 feet to the Grantee's Southeast corner; thence North 220.00 feet to the centerline of Howe Road and the North line of Lot 22; thence East 20.00 feet along the centerline of Howe Road and the lot line to the beginning. Containing 1.051 acres of land, be the same more or less, but subject to all legal highways as surveyed in December, 1972, by David J. Collier, Registered Surveyor No. 4819.

EXCEPTION TO PARCEL ONE:

Situated in the Township of Brimfield, County of Portage and State of Ohio and known as being part of Lot 22 in Brimfield Township and further described as follows:

Starting at the Northeast corner of Lot 22; thence West 687.34 feet along the centerline of Howe Road and the North line of Lot 22 to the Grantee's, Northeast corner; thence South 240.00 feet to an iron pipe at the Grantee's Southeast corner and the true place of beginning for this parcel of land herein described; thence South 100.00 feet to an iron pipe at the Grantor's Southeast corner; thence West 150.00 feet along the Grantor's South line to a point; thence North 100.00 feet to an iron pipe at the Grantee's Southwest corner; thence East 150.00 feet to the beginning containing 0.344 of an acre of land, be the same more or less, as surveyed in March 1992 by Edward J. Collier, Registered Surveyor No. 7141.

PARCEL TWO:

Situated in the Township of Brimfield, County of Portage and State of Ohio and further described as follows:

Beginning at the Northeast corner of Lot 22 of said township; thence due West along the centerline of Township Highway 83 known as Howe Road and the North line of said Lot 22, a distance of 857.34 feet to a point which is the true place of beginning; thence due South and passing over an iron pipe at 30.00 feet from the center of the road, a distance of 220.00 feet to an iron pipe; thence due West, a distance of 200.00 feet to an iron pipe; thence due North and passing over an iron pipe 30.00 feet from the center of the road a distance of 220.00 feet to a point in the center of T.H. 83 and on the North line of Lot 22; thence due East along the centerline of T.H. 83 and the North line of said Lot 22, a distance of 200.00 feet to the place of beginning and containing 1.010 acres of land as surveyed by L. M. Satrom, Registered Surveyor No. 4226.

Said Premises Appraised at SET MIMINUM BID $48,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid is required from third party purchasers at the time of sale. Conveyance and Recording Fees are required from all bidders at the time of sale. The balance of the purchase price shall be paid within thirty (30) days after the date the confirmation is filed with the clerk.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
