In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 1st Floor of the Courthouse, in the Magistrate John P. O'Neill's Courtroom, Courtroom C in Ravenna, in the above named County, on Monday, August 30, 2010, at 11:00 A.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Deerfield to-wit:

Situated in the Township of Deerfield, County of Portage and State of Ohio:

And known as being part of Lot No. 63 in said township and more fully bounded and described as follows, to-wit:

Beginning at the intersection of County Highway No. 73 and the North line of said Lot No. 63 (which is also the Northwest corner of a 32.00 acre parcel of land deeded to Pearl Beal and Cora Alvey May 5, 1936 and recorded in Book 346, Page 290, Portage County Records). Also an iron pipe set South 29 deg. 58' 30" E., 30.00 feet from said beginning point; thence along the North line of said Lot No. 63, South 89 deg. 45' E., 640.96 feet; thence South 0 deg. 15' W. (passing thru an iron pipe at 20.00 feet) 300.00 feet to an iron pipe); thence N. 89 deg. 45' W., 811.04 feet to the centerline of said C.H. No. 73; thence North 29 deg. 48' E., 344.85 feet to the place of beginning as surveyed in September, 1944 by Leo E. Martin, Registered Surveyor No. 2587, .5 acres.

Beginning at a point in the North line of said Lot No. 63, S. 89 deg. 45' E., 580.96 feet from the intersection of said North line and the centerline of C.H. 73 now known as Mahoning Road (Deerfield-Newton Falls Road); thence continuing along the North line of said Lot No. 63, S. 89 deg. 45' E., 60.00 feet; thence S. 0 deg. 15' W., (passing over an iron pipe at 20.00 feet) 100.00 feet to an iron pipe; thence N. 89 deg. 45' W., 60.00 feet to an iron pipe; thence N. 0 deg. 15' E., (passing over an iron pipe at 80.00 feet) 100.00 feet to the place of beginning, as surveyed by Leo E. Martin, Reg. Sur. No. 2587, February, 1954. 0.138 acres.

Beginning at the intersection of the North line of Lot 63 and the center line of Mahoning Road, CH 73; thence South 89 deg. 45' East along the North line of Lot 63 and the centerline of Woodard Road, C.H. 70, 435.76 feet to the place of beginning; thence continuing along said lot line and centerline, South 89 deg. 45' East, 145.20 feet; thence South 0 deg. 15' West, passing over an iron pin at 20.00 feet, 300 feet to an iron pin; thence North 89 deg. 45' West, 145.20 feet to an iron pin; thence North 0 deg. 15' East, 300 feet to the true place of beginning and passing over an iron pin 20 feet from the centerline as surveyed April 21, 1965 by Dana D. Dawley, RS No. 4829. 1 acre.

Situated in the township, county and state aforesaid and being part of Lot 63 and further described as follows:

Beginning at the intersection of the North line of Lot 63 and the centerline of Mahoning Road, CH 73; thence South 89 deg. 45' East, along the North line of Lot 63 and the centerline of Woodard Road, CH 70, 640.96 feet; thence South 0 deg. 15' West, 100 feet to the true beginning; thence continuing South 0 deg. 15' West, 200 feet to an iron pin; thence North 89 deg. 45' West, 60 feet to an iron pin; thence North 0 deg. 15' East, 200 feet; thence South 89 deg. 45' East, 60 feet to the true beginning as surveyed by Dana D. Dawley, R.S. No. 4289, April 21, 1965. 0.275 acres.

PARCEL FOUR:

Being a parcel of land located in Lot 63, Deerfield Township, Portage County, State of Ohio and further described as follows:

Commencing at the intersection of the centerline of Mahoning Rd. (CH 73) and Woodard Road (CH 70) which centerline is also the lot line between Lot 63 and Lot 64; thence South 89 deg. 45' East along the centerline of Woodard Rd. and the North line of Lot 63, a total distance of 290.56 feet to a railroad spike set on the centerline of said highway, which point is the true place of beginning for this survey; thence continuing South 89 deg. 45' East along the centerline of Woodard Rd. and the North line of Lot No. 63, a total distance of 145.20 feet to a railroad spike set on said centerline; thence South 0 deg. 15' West along the Westerly property line of land now or formerly owned by P. R. and T. L. Merritt and passing over two iron pins, one found at 20.00 feet, and one set 30.00 feet at the side line of Woodard, a total distance of 300.00 feet and to an iron pin found, which point is the South West corner of said Merritt property; thence North 89 deg. 45' West along the Northerly property line of land now or formerly owned by Pearl and Ernest Beal, a total distance of 145.20 feet to an iron pin set on the Northerly line of said property; thence North 0 deg. 15' East along a line running through the Grantor's property and passing over an iron pin set 30.00 feet at the side line of Woodard Road, a total distance of 300.00 feet to a railroad spike which point is the true place of beginning for this survey and as surveyed in June 1970 by Floyd L. Thomas, Registered Surveyor No. 5461 of the State of Ohio. 1 acre.

NOTE:

Notwithstanding the reference to acreage or square footage in the description set forth in Schedule A hereof, this policy does not insure nor guarantee the acreage or quantity of land set forth therein.

Said Premises Located at 10644 Woodard Rd., Deerfield, OH 44411.

Said Premises Appraised at $75,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid is required from third party purchasers at the time of sale. Conveyance and Recording Fees are required from all bidders at the time of sale. The balance of the purchase price shall be paid within thirty (30) days after the date the confirmation is filed with the clerk.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
