In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 3rd Floor of the Courthouse, in the Hon. Laurie J. Pittman's Courtroom in Ravenna, in the above named County, on Monday, May 24, 2010, at 12:00 P.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the City of Kent to-wit:

Situated in the State of Ohio, County of Portage and City of Kent and being part of Lot 22 Franklin Township. Beginning at the Southwest corner of the Joanne L. Pizzino Subdivision Plat Book 90-8, said point is the true place of beginning for the property herein described, witness an iron pipe found; thence N. 89 deg. 36' 00" E., along the South line of the Joanne L. Pizzino Subdivision Plat Book 90-8, a distance of 100.00 feet to an iron pipe found; thence turning S. 00 deg. 24' 00" E., along the West line of J. or N. Alldredge Deed Volume 1104, Page 84, a distance of 242.80 feet to a point in the centerline of Horning Rd. and passing over an iron pipe found 32.11' from the centerline; thence turning N. 69 deg. 30' 00" W., along the centerline of Horning Rd., a distance of 107.07 feet to a point in said centerline; thence turning N. 00 deg. 24' 00" W., along the East line of J. D. Plymale Deed 200128790, a distance of 204.62 feet back to the true place of beginning and passing over an iron pipe found 32.11' from the centerline. The amount of area contained in this property is 0.5137 acres of land more or less, but excepting all legal highways of record. This basis of bearing is to an assumed meridian and denotes angles only. The survey was performed by Terrence L. Pearson, P.S. 7305 in April of 2005. The property being conveyed is held in fee title by J. D. Speight and D. Jarjoura Deed Volume 1108, Page 269. Be the same more or less, but subject to all legal highways.

Said Premises Located at 5924 Horning Rd., Kent, OH 44240.

Said Premises Appraised at $137,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid, cash or check, payable to the Portage County Sheriff is required at the time the bid is accepted. The balance of Purchase Price shall be paid within thirty (30) days after the date of sale.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
