In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 3rd Floor of the Courthouse, in the Hon. Laurie J. Pittman's Courtroom in Ravenna, in the above named County, on Monday, May 24, 2010, at 12:00 P.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Shalersville to-wit:

Situated in the State of Ohio, County of Portage, Township of Shalersville, known as being part of Lot 46 and being a parcel of land now or formerly in the name of Leanne Martindale as recorded in Volume 949, Page 196 of the Portage County Records of Deeds, and more fully described as follows:

Commencing for reference at the centerline intersection of State Route 44 (120' wide) and State Route 303 (120' wide), being the Southeast corner of Lot 46; thence North 89 53' 24" West, along the centerline of State Route 303 and the South line of Lot 46, a distance of 812.69 feet to a point; thence North 00 28' 49" West, a distance of 60.00 feet to a 1" pipe found on the North right-of-way line of State Route 303 and the true place of beginning of the parcel of land herein described; thence North 00 28' 49" West, along the East line of a parcel of land now or formerly in the name of Tami Jones as recorded in Volume 1115, Page 966, a distance of 261.57 feet to a 1/2" rebar set; thence North 89 42' 13" East, along the South line of a parcel of land now or formerly in the name of Crawford Fitting Company as recorded in Volume 1104, Page 40, a distance of 75.00 feet to a 1/2" rebar set; thence South 00 28' 49" East, along the West line of a parcel of land now or formerly in the name of Jeffrey H. Bujak as recorded in Volume 372, Page 425 passing over a 1" pipe found at 261.89 feet, a distance of 262.32 feet to a point in the North right-of-way line of State Route 303; thence North 89 53' 24" West, along said North line a distance of 75.00 feet to the true place of beginning and containing 0.4510 acres (19,646 square feet) of land, more or less, as surveyed in September 2000 by Timothy R. Durr, Registered Professional Surveyor Number 7788, for an on behalf of Millman Surveying, Inc. under Project No. 1755 and is subject to all legal highways as easements of records. Dimessions in this description are expressed in feet and decimal pasts thereof unless otherwise noted. The basis of bearings for this survey is North 89 53' 24" West, being the centerline of State Route 303, as evidenced by monuments found and is the same bearing as shown on Plat 91-31.

All iron pins referred to an being set in this description are 1/2 inch diameter x 30 inches in length with a plastic cap bearing the name of the company that prepared this description.

Said Premises Appraised at $75,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid, cash or check, payable to the Portage County Sheriff is required at the time the bid is accepted. The balance of Purchase Price shall be paid within thirty (30) days after the date of sale.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
