In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 3rd Floor of the Courthouse, in the Hon. Laurie J. Pittman's Courtroom in Ravenna, in the above named County, on Monday, May 24, 2010, at 12:00 P.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Franklin to-wit:

Situated in the Township of Franklin, County of Portage and State of Ohio:

Known as and being part of Original Lot 72 and is further described as follows:

Commencing at a marked stone at the Southeast corner of said Lot 72 and the intersection of the East line of Franklin Township with the centerline of Red Brush Road (CH 158); thence North 53 deg. 02' 16" West, along the cneterline of Red Brush Road, a distance of 430.98 feet to a rail spike which is the true place of beginning for the following described parcel; thence continuing North 53 deg. 02' 16" West, as in the previous course, a distance of 178.82 feet to an iron rod; thence North 58 deg. 43' 13" West along said road centerline, a distance of 29.50 feet to a rail spike; thence North 34 deg. 07' 15" East, passing witness pins at 20.02 feet, 126.66 feet and 311.21 feet, a distance of 444.28 feet to a point; thence North 02 deg. 26' 15" East, a distance of 260.83 feet to a point on the Grantor's Northerly line; thence South 87 deg. 33' 45" East, a distance of 297.09 feet along the South line of land owned by Stanley A. or Katherine J. Smith (1023/507) to an iron pin at Smith's Southeast corner; thence South 02 deg. 33' 50" West, along the Franklin Township-Ravenna Township line, a distance of 752.56 feet to an iron pin at the Northeasterly corner of land owned by H. & J. Deffenbaugh (753/615); thence North 87 deg. 52' 17" West, along said the Deffenbaugh's Northerly line, a distance of 355.62 feet, passing a witness pin at 320.16 feet to the beginning and containing 6.520 acres of land, be the same more or less, but subject to all legal highways and easements of record. Surveyed and described in June, 1986, by Nolen K. Simon, Registered Surveyor No. 6311.

Said Premises Located at 7222 Red Brush Rd., Ravenna, OH 44266.

Said Premises Appraised at $218,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid, cash or check, payable to the Portage County Sheriff is required at the time the bid is accepted. The balance of Purchase Price shall be paid within thirty (30) days after the date of sale.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
