In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 3rd Floor of the Courthouse, in the Hon. Laurie J. Pittman's Courtroom in Ravenna, in the above named County, on Monday, March 29, 2010, at 12:00 P.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Franklin to-wit:

Situated in the Franklin Township, County of Portage, State of Ohio and known as being a part of Franklin Township Lot 47 and also being a part of land owned by CDD Development, LLC, an Ohio Limited Liabilty Company as recorded in Instrument Number 200301056 of Portage County Records and more fully described as follows:

Beginning at a 1/4" rebar found at the intersection of the West line of said Lot 47 and the centerline of Johnson Road, C.H. 141 (60' R/W); thence Southeasterly along said centerline S. 81 deg. 15' 02" E., 806.67 feet to the true place of beginning for the land hereinafter described; thence N. 07 deg. 54' 57" W., 1354 25 feet (passing over a number five rebar set at 31 32') to a number five rebar set; thence N. 03 deg. 49' 30" W., 576 25 feet to a number five rebar set on the Northerly line of said Lot 47; thence Northeasterly along the Northerly line of Lot 47, N. 89 deg. 13' 145" E., 465 18 feet to a number five rebar set; thence S. 25 deg. 44' 17" W., 587 33 feet to a number five rebar set; thence S. 06 deg. 56' 20" E., 1428.24 feet to the centerline of Johnson Road (passing over a number five rebar set at 1387.81'); thence Northwesterly along the centerline of Johnson Road, N. 81 deg. 15' 02" W., 159.53 feet to the true place of beginning for the land hereinbefore described and containing 9.2343 acres of land (0.1132 acres being in the road) as surveyed by Daniel C. Kalstrom, Professional Surveyor (Registration Number 6302) in July, 2003 and subject to all legal highways, easements and restrictions of record. Bearings in the above description are based on the Ohio Coordinate System, North Zone, NAD83, number five rebars set bear a plastic cap inscribed, "Kalstrom, P.S. 6302". Excepting therefrom the following described parcel dedicated as pubic roadway. Situated in Franklin Township, County of Portage, State of Ohio and known as being a part of Franklin Township Lot 47 and being a part of land dedicated by Plat 2001-9 recorded at the Portage County Records and more fully described as follows:

Beginning at a 3/4" rebar found at the intersection of the West line of said Lot 47 and the centerline of Johnson Road, C.H. 141 (60' R/W); thence Southeasterly along said centerline S. 81 deg. 15' 02" E., 966.20 feet to a point; thence N. 06 deg. 56' 20" W., 31 16 feet to the Northerly line of Johnson Road and the true place of beginning for the land hereinafter described; thence Northwesterly along the Northerly line of Johnson Road, N. 81 deg. 15' 02" W., 31.03 feet to a point; thence Northeasterly along the dedicated Northerly line of Johnson Road, N. 81 deg. 22' 44" E., 29 89 feet to a point; thence S. 06 deg. 56' 20" E., 9.27 feet to the place of beginning and containing 0 0032 acres of land as surveyed by Daniel C. Kalstrom, Professional Surveyor (Reg. No. 6302) in July, 2003.

Said Premises Located at 529 Johnson Rd., Kent, OH 44240.

Said Premises Appraised at $98,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid, cash or check, payable to the Portage County Sheriff is required at the time the bid is accepted. The balance of Purchase Price shall be paid within thirty (30) days after the date of sale.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
