In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 3rd Floor of the Courthouse, in the Hon. Laurie J. Pittman's Courtroom in Ravenna, in the above named County, on Monday, March 1, 2010, at 12:00 P.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Village of Garrettsville to-wit:

Situated in the Village of Garrettsville, County of Portage and State of Ohio and being known as a part of Original Lot No. 1 in Nelson Township before the organization of Garrettsville Township and Village and more particularly known as being a part of Subdivision No. 6 according to the survey of J. Cole, made in 1870, recorded in Volume 7, Page 2, Portage County Plat Records, bounded and described as follows:

Beginning in the center of South Avenue at the Southwest corner of Village Lot No. 30 to the auditor's plat book of said village, which point is 2 chains South of the Northeast corner of said Subdivision No. 6; thence East along the South line of said Village Lot No. 30, 5 chains to the Southeast corner of said village lot; thence South parallel with the centerline of South Avenue 60 feet; thence West parallel with the South line of Village Lot No. 30, 5 chains to the center of South Avenue; thence North along the center of said avenue, 60 feet to the place of beginning. Containing 0.45 acre of land.

PARCEL 2:

Situated in the Village of Garrettsville, County of Portage and State of Ohio and being a tract of land located in Original Nelson Township Lot No. 1 and further described as follows:

Beginning at a monument and cast iron monument box located at the intersection of the South corporation line of the Village of Garrettsville and the centerline of South Street; thence North 0 deg. 03' East, along the center of South Street 1587.23 feet to a point; thence South 89 deg. 57' East, the East line of South Street 30.00 feet to an iron pipe; being the principal place of beginning for the following conveyance; thence South 89 deg. 57' East, along the Linda Read aka Linda R. Read property line 300.00 feet to an iron pipe; thence South 0 deg. 03' West, and 60.00 feet to an iron pipe; thence North 89 deg. 57' West, 300.00 feet to an iron pipe set in the East line of South Street; thence North 0 deg. 03' East, along the East line of South Street 60.00 feet to the principal place of beginning and containing .41 acre of land.

Exception to Parcel No. 2:

Situated in the Village of Garrettsville, County of Portage and State of Ohio and known as being part of Original Nelson Township Lot No. 1 village, county and state aforesaid and more particularly described as follows:

Beginning at a monument in a cast iron monument box located at the intersection of the South corporation line of the Village of Garrettsville with the centerline of South Street; thence North 00 deg. 03' East along the centerline of South Street for a distance of 1,528.25 feet to a small iron pin; thence at right angles to the preceding course South 89 deg. 57' East for a distance of 30.00 feet to an iron pipe which marks the true place of beginning of the following described parcel of land. This true place of beginning is at the Southwest corner of a parcel of land (fronting on Center Street a distance of 120.00 feet) now standing in the name of Linda Read aka Linda R. Read; thence North 00 deg. 03' East along the East line of Center Street for a distance of 10.00 feet to an iron pin; thence at right angles to the previous course South 89 deg. 57' East for a distance of 300.00 feet to an iron pin; thence at right angles to the course South 00 deg. 03' West for a distance of 10.00 feet to an iron pin; thence at right angles to the previous course North 89 deg. 57' West for a distance of 300.00 feet to the true place of beginning and found to contain 0.069 acre of land as surveyed by Lucius F. Converse, Registered Surveyor No. 1199 in June 1965. Be the same more or less, but subject to all legal highways.

Legal Description in Warranty Deed 1158, Page 723 contains a scrivener's error; should by "thence South 0 deg. 03' West" instead of "thence South 0" 03' West". Said error does not materially affect the integrity or insurability of the transfer of title to the Grantee.

Said Premises Located at 10468 South St., Garrettsville, OH 44231.

Said Premises Appraised at $88,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid, cash or check, payable to the Portage County Sheriff is required at the time the bid is accepted. The balance of Purchase Price shall be paid within thirty (30) days after the date of sale.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
