In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 3rd Floor of the Courthouse, in the Hon. Laurie J. Pittman's Courtroom in Ravenna, in the above named County, on Monday, November 23, 2009, at 12:00 P.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Village of Hiram to-wit:

PARCEL 1:

Situated in the Village of Hiram, County of Portage and State of Ohio and known as being part of Original Hiram Township Lot No. 28 and is further described as follows:

Beginning at a monument box assembly found in the centerline of Garfield Road, 80 deg. wide at its intersection with the centerline of Wakefield Road, 66' wide; thence along the centerline of Garfield Road S. 02 deg. 15' 00" W., a distance of 1064.88 feet to a point which is the true place of beginning for this parcel of land; thence S. 88 deg. 51' 00" E., a distance of 530.85 feet to a point and passing over an iron rod found at a distance of 30.00 feet; thence S. 01 deg. 09' 00" W., a distance of 182.46 feet to an iron rod set in the Southerly line of lands now or formerly owned by D. Orr, et al. (946/95) and passing over an iron rod set at a distance of 5.00 feet; thence along the Southerly line of the said D. Orr, et al., N. 88 deg. 51' 00" W., a distance of 534.15 feet to a point in the centerline of Garfield Road and passing over an iron rod set at a distance of 35.00 feet from said point; thence along the centerline of Garfield Road N. 02 deg. 15' 00" E., a distance of 162.49 feet to the true place of beginning and containing a total of 2.2300 acres of land of which 0.1257 acres are currently occupied by the road right of way, be the same more or less as surveyed and described in July 1999 by Don Trocchio, Registered Surveyor No. 6445.

Beginning at a monument box assembly found in the centerline of Garfield Road, 60' wide at its intersection with the centerline of Wakefield Road, 66' wide; thence along the centerline of Garfield Road, S. 02 deg. 15' 00" W., a distance of 1064.88 feet to a point; thence S. 88 deg. 51' x" E., a distance of 530.65 feet to a point and passing over an iron rod found at a distance of 30.00 feet; thence S. 01 deg. 09' 00" W., a distance of 82.50 feet to a point which is the true place of beginning for this parcel of land and passing over an iron rod set at a distance of 5.00 feet; thence S. 88 deg. 51' 00" E., a distance of 300.00 feet to a point; thence N. 01 deg. 09' 00" E., a distance of 147.50 feet to a point in the Northerly line of lands now or formerly owned by D. Orr, et al. (948/951); thence along the Northerly line of the said D. Orr, et al., S. 88 deg. 51' 00" E., a distance of 403.69 feet to an iron rod found at the Northeast corner of said D. Orr, et al.; thence along the rear or Easterly line of the said D. Orr, et al., S. 02 deg. 15' 00" W., a distance of 247.60 feet to an iron rod found at the Southeast corner of the said D. Orr, et al., a buggy axle found bears N. 59 deg. 20' 25" E., a distance of 1.34 feet from said iron rod; thence along the Southerly line of the said D. Orr, et al., N. 88 deg. 51' 00" W., a distance of 698.54 feet to an iron rod set; thence N. 01 deg. 09' 00" E., a distance of 99.96 feet to the place of beginning and containing a total of 2.9676 acres of land be the same more or less as surveyed and described in July 1999 by Don Trocchio, Registered Surveyor No. 3446.

Situated in the Township and Village of Hiram, Lot 28, County of Portage and State of Ohio:

And being further bounded and described as follows:

Beginning at a point, which point is the Northwest corner of lands of Jennifer Orr, et al., in the center line of Garfield Road, 60 feet wide (formerly known as the North and South Road) which bears South 2 deg. 15' West for a distance of 1006 from its intersection with Wakefield Road (66 feet wide); thence South 88 deg. 51' East, along the Southline of lands belonging to H. J. Demian, a distance of 616.50 feet to an iron pin found at an angle point in said Demian's lands; thence North 01 deg. 45' East, a distance of 8.00 feet to an iron pin found at an interior angle in Demian's lands; thence South 88 deg. 51' East, continuing along Demian's Southline, a distance of 212.95 feet to an iron pin set; thence South 01 deg. 09' West, a distance of 147.50 feet to an iron pin set; thence North 86 deg. 51' West, a distance of 300.00 feet to an iron pin set; thence North 01 deg. 09' East, a distance of 82.50 feet to an iron pin set; thence North 88 deg. 51 West, a distance of 630.65 feet to the centerline of Garfield Road, passing thru an iron pin set 30.00 feet therefrom; thence North 02 deg. 16' East, along Garfield Road centerline, a distance of 60.01 feet to the place of beginning and containing within said described boundaries 1.7360 acres of land, be the same more or less, but subject to all legal highways. This being a part of the lands previously belonging to Kathleen Orr, Daniel Orr, Jennifer Orr, Marianne Orr, and Michael Orr, by Portage County Deed Records, Volume 946, Page 951 and is pursuant to a survey made by J. M. Peter, Ohio Registration Number 6420.

Said Premises Appraised at $260,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid, cash or check, payable to the Portage County Sheriff is required at the time the bid is accepted. The balance of Purchase Price shall be paid within thirty (30) days after the date of sale.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
