In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 3rd Floor of the Courthouse, in the Hon. Laurie J. Pittman's Courtroom in Ravenna, in the above named County, on Monday, November 23, 2009, at 12:00 P.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Rootstown to-wit:

And known as being Sublot 16-R in the replat of Lots 16, 17, 18 of Shaw Allotment as recorded in Volume 31, Page 22 of the Portage County Records of Plats.

And being known as Lot No. 38 in Shaw Allotment No. 3, as recorded in Volume 17, Page 41 of Portage County Recorder's Book of Plats. Exception to Parcel 2:

Beginning at the Southeasterly corner of Sublot 38 in the Shaw Allotment No. 3, as recorded in Volume 17, Page 41, of the Portage County Records of Plats; thence N. 88 deg. 16' W., along the Southerly line of said Sublot No. 38, a distance of 156.23 feet to a point; thence N. 01 deg. 35' W., a distance of 178.04 feet to a point in the Northerly line of Sublot 38; thence N. 88 deg. 48' E., along the Northerly line of Sublot 38, a distance of 155.98 feet to the Northeasterly corner of Sublot 38; thence S. 01 deg. 35' E., along the Easterly line of Sublot 38, a distance of 186.04 feet to the place of beginning, containing 0.651 acres of land, as surveyed October 21, 1971, by Albert Szuch, Registered Surveyor No. 5398.

TERMS OF SALE: Cash.

A deposit of 10% of your bid, cash or check, payable to the Portage County Sheriff is required at the time the bid is accepted. The balance of Purchase Price shall be paid within thirty (30) days after the date of sale.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
