In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 3rd Floor of the Courthouse, in the Hon. Laurie J. Pittman's Courtroom in Ravenna, in the above named County, on Monday, October 19, 2009, at 12:00 P.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Freedom to-wit:

Situated in the Township of Freedom, County of Portage and State of Ohio and known as being part of Lot 43 of said township and further bounded and described as follows:

Beginning at a point on the centerline of Nichols Road (C.H. 225-0), said point being North 0 deg. 30' 00" East, a distance of 719.97 feet from the Southeast corner of Lot 43; thence North 89 deg. 19' 53" West and passing over an iron pin set at 30.00 feet, a distance of 1565.00 feet to an iron pin set; thence North 0 deg. 30' 00" East, a distance of 160.00 feet to an iron pin set; thence South 89 deg. 19' 53" East and passing over an iron pin set at 1635.00 feet, a distance of 1665.00 feet to a point on the centerline of said Nichols Road; thence South 0 deg. 30' 00" West, along said road centerline, also being the line between Lot 43 and Lot 33, a distance of 160.00 feet to a point and the true place of beginning and containing therein 6.1157 acres of land as surveyed in February 2005 by Jerry W. Daniel, Registered Surveyor No. 6222. Bearings are based on survey plat fre-32.

Iron pins set are 5/8" x 30" rebar capped "JW Daniel".

A deposit of 10% of your bid, cash or check, payable to the Portage County Sheriff is required at the time the bid is accepted. The balance of Purchase Price shall be paid within thirty (30) days after the date of sale.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
