In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 3rd Floor of the Courthouse, in the Hon. Laurie J. Pittman's Courtroom in Ravenna, in the above named County, on Monday, October 19, 2009, at 12:00 P.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Village of Brady Lake to-wit:

Known as being part of Lot 38 in Franklin Township, and further as described, beginning at an iron pin found at the Southeast corner of Sublot 276 of the Brady Lake Park Allotment, as recorded in Plat Book 4, Page 5 of the Portage County Records; thence S. 81 deg. 32' 20" E., a distance of 110.00 feet to a pin found at the Southeast corner of Park Avenue; thence S. 08 deg. 27' 40" W., a distance of 33.34 feet to a pin set and the true place of beginning for the parcel herein to be conveyed; thence N. 75 deg. 53' 20" E., a distance of 120.56 feet to a pin set on the right of way of Park Avenue extension; thence with said Park Ave. extension S. 77 deg. 25' 20" E., a distance of 80.00 feet to a pin found; thence S. 81 deg. 47' 50" W., a distance of 199.48 feet to a pin found; thence N. 81 deg. 32' 20" W., a distance of 127.00 feet to a pin found; thence N. 43 deg. 57' W., a distance of 100.07 feet to a pin found; thence N. 77 deg. 18' W., a distance of 349.41 feet to a point in Brady Lake and passing over a pin set at 150.00 feet; thence N. 00 deg. 28' W., a distance of 102.70 feet to a point; thence S. 77 deg. 18' E., a distance of 441.91 feet to a pin set and passing over a pin set at 241.91 feet; thence S. 08 deg. 27' 41' W., a distance of 139.00 feet to a pin set; thence S. 81 deg. 32' 30" E., a distance of 129.98 feet to the place of beginning. The above described tract of land contains 1.1786 acres of land, more or less but subject to all legal highways, easements and restrictions of record, if any, as surveyed and determined from local deeds and monumentation in April 1997, pins set are #4 rebar and caps (D. Bedore 6023), by Douglas E. Bedore, Professional Surveyor No. 6023. Bearings are to an assumed meridian and are used to denote angles only.

Said Premises Located at 6465 Park Avenue, Kent, OH 44240.

Said Premises Appraised at $180,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid, cash or check, payable to the Portage County Sheriff is required at the time the bid is accepted. The balance of Purchase Price shall be paid within thirty (30) days after the date of sale.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
