In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 3rd Floor of the Courthouse, in the Hon. Laurie J. Pittman's Courtroom in Ravenna, in the above named County, on Monday, August 17, 2009, at 12:00 P.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Nelson to-wit:

Situated in the Township of Nelson, County of Portage and State of Ohio and being part of Lot 11 of said township and being further bounded and described as follows:

Beginning at a railroad spike found by the Northwest corner of said Lot 11; thence South 0 deg. 46' 16" West, along the West line of said lot and the centerline of Brosius Road (C.H. 289), a distance of 1218.29 feet to a point, said point also being the Southwest corner of land conveyed to P. or E. Rothwell by Volume 958, Pg. 408 of Portage County Record of Deeds and the true point of beginning for the parcel herein described; thence South 88 deg. 23' 30" East, along the South line of said Rothwell's land and passing over a 5/8" capped rebar found at 30.00 feet, a distance of 350 feet to a 5/8" capped rebar found at the Southeast corner of said Rothwell's land; thence North 0 deg. 46' 16" East, along said Rothwell's East line, a distance of 214.94 feet to a 5/8" capped rebar set; thence South 88 deg. 23' 30" East, a distance of 376.37 feet to a 5/8" capped rebar set; thence South 1 deg. 13' 00" West, a distance of 611.84 feet to a 5/8" capped rebar set; thence North 88 deg. 38' 00" West, passing over a 1/2" pipe found at 691.58 feet, a distance of 721.58 feet to a point on said lot line and road crossing; thence North 0 deg. 46' 16" East, along said lot line and road centerline, a distance of 400.00 feet to the true place of beginning and containing 8.4674 acres of land as surveyed in March, 2003 by Clifford H. McGuire, Professional Surveyor No. 7770.

A deposit of 10% of your bid, cash or check, payable to the Portage County Sheriff is required at the time the bid is accepted. The balance of Purchase Price shall be paid within thirty (30) days after the date of sale.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
