In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 3rd Floor of the Courthouse, in the Hon. Laurie J. Pittman's Courtroom in Ravenna, in the above named County, on Monday, August 17, 2009, at 12:00 P.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Ravenna to-wit:

Situated in the Township of Ravenna, County of Portage and State of Ohio:

And known as being part of Lot 12 in the South Division of lots in said township; beginning at a point 100 feet Southwesterly from the most Northerly corner of Sublot 16 of Block B of McElrath Park Allotment; thence Northwesterly parallel with Cleveland Road approximatley 219 feet to a point; thence Northeasterly parallel with the Westerly line of said Sublot 16 approximately 99.76 feet to the Southerly line of Garfield Road; thence Northwesterly along the Southerly line of Garfield Road a distance of 101.60 feet to the Northeast corner of Lot No. 34 of Block B of McElrath Park Allotment; thence Southwesterly along the Easterly line of Lots Nos. 34 and 17 of said Block B a distance of 363 feet to the Northeasterly line of Cleveland Road; thence Southeasterly along a line of Cleveland Road 320 feet to the Southwest corner of Lot No. 6 of Block B of McElrath Park Allotment; thence Northeasterly along the Westerly lines of Lots No. 6 and 16 of said Block B, a distance of 263 feet to the place of beginning, containing 2.49 acres of land. Be the same more or less, but subject to all legal highways.

Excepting therefrom the following described parcel:

And known as being part of Lot 12 in the South Division of Ravenna Township and further described as follows:

Beginning at an iron pipe in the Easterly line of Cleveland Road at the Grantor's most Southerly corner and being North 46 deg. 03' 40" West, 180.00 feet from the intersection of said road line with the Northerly line of Winfield Street; thence North 46 deg. 03' 40" West, 30.00 feet along the Easterly line of Cleveland Road to an iron pipe set; thence North 43 deg. 53' 00" East, 263.00 feet to an iron pipe set in the Grantor's Easterly line; thence South 46 deg. 03' 40" East, 30.00 feet to an iron bar at the Grantor's most Easterly corner; thence South 43 deg. 53' 00" West, 263.00 feet along the Grantor's Southerly line to the beginning; containing 0.181 of an acre of land, more or less, as surveyed in January 2002, by Edward J. Collier, Registered Surveyor No. 7141. Be the same more or less, but subject to all legal highways.

Said Premises Located at 6650 Cleveland Road, Ravenna, OH 44266.

Said Premises Appraised at $100,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid, cash or check, payable to the Portage County Sheriff is required at the time the bid is accepted. The balance of Purchase Price shall be paid within thirty (30) days after the date of sale.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
