In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 3rd Floor of the Courthouse, in the Hon. Laurie J. Pittman's Courtroom in Ravenna, in the above named County, on Monday, June 15, 2009, at 12:00 P.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Deerfield to-wit:

Situated in the Township of Deerfield, County of Portage and State of Ohio and known as being part of Lot 29 of said township, and further bounded and described as follows:

Beginning at an iron pin set on the East line of State Route 14, also known as Cleveland-East Liverpool Road on the North line of land conveyed to R. W. and B. J. Bright by deed recorded in Volume 936, Page 36 of Portage County Record of Deeds, said point being South 0 deg. 05' 15" West, a distance of 2228.34 feet from a 3/4" iron pipe found in a monument box on the East line of said State Route 14 at its intersection with the South line of Akron-Canfield Road (S.H. 87) also known as U.S. Rt. 224; thence North 0 deg. 05' 15" East, along said East line of State Route 14, a distance of 301.00 feet to an iron pin set; thence South 89 deg. 15' 50" East, a distance of 562.50 feet to an iron pin set; thence North 0 deg. 05' 15" East, and passing over an iron pin set at 125.00 feet, a distance of 250.00 feet to an iron pin set on the South line of land conveyed to Murphy's Separate Acres L.L.C. as recorded in Volume 911, Page 777 of Portage County Record of Deeds; thence South 89 deg. 15' 50" East, along said South line of Murphy's Separate Acres L.L.C. land, a distance of 196.72 feet to a 3/4" iron pin found at an interior corner thereof; thence South 0 deg. 12' 58" West, along a West line of said Murphy's Separate Acres L.L.C. land, a distance of 544.88 feet to an iron pin set at the Northeast corner of said Bright's land; thence North 89 deg. 43' 33" West, along the North line of said Bright's land, a distance of 757.95 feet to a point and the true place of beginning and containing therein 6.3139 acres of land as surveyed in July, 2005 by Jerry W. Daniel, Registered Surveyor No. 6222.

Said Premises Located at 1096 State Route 14, Deerfield, OH 44411.

Said Premises Appraised at $125,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid, cash or check, payable to the Portage County Sheriff is required at the time the bid is accepted. The balance of Purchase Price shall be paid within thirty (30) days after the date of sale.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
