In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 3rd Floor of the Courthouse, in the Hon. Laurie J. Pittman's Courtroom in Ravenna, in the above named County, on Monday, June 1, 2009, at 12:00 P.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Windham to-wit:

Situated in the Township of Windham, County of Portage and State of Ohio:

Being a parcel of land located in Lot 79, Windham Township, Portage County, State of Ohio and being further described as follows:

Commencing at the intersection of the centerline of Horn Road (T.H. 239-B), which is also the Westerly lot line of Lot 79, and the centerline of State Route 82, Twinsburg-Warren Road (S.H. 474); thence South 74 deg. 15' East along the centerline of St. Rt. 82 (S.H. 474), a total distance of 1,763.10 to a road nail on the centerline of said highway which point is the true place of beginning for this survey; thence continuing along the centerline of St. Rt. 82 (S.H. 474), a total distance of 110.00 feet to a road nail set which point is 158.8 feet North 74 deg. 15' West from the Westerly property line of E. G. Haynie; thence South 4 deg. 45' West along the Westerly property line of land now or formerly owned by R. Dollison and passing over an iron pin set at 30.58 feet a total distance of 600.00 feet to an iron pin set on the Westerly property line of said property; thence North 85 deg. 15' West along a line running through the Grantors property, a total distance of 107.98 feet to an iron pin set; thence North 4 deg. 45' East along a line running through the Grantors property and passing over an iron pin set at 590.43 feet, a total distance of 620.99 feet to a road spike, which point is the true place of begining for this survey as surveyed in September 1970 by Floyd L. Thomas and Sam Janka, Registered Surveyors Nos. 5481 and 5739 of State of Ohio, be the same more or less, but subject to all legal highways.

Said Premises Located at 10128 State Route 82, Windham, OH 44288.

Said Premises Appraised at $150,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid, cash or check, payable to the Portage County Sheriff is required at the time the bid is accepted. The balance of Purchase Price shall be paid within thirty (30) days after the date of sale.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.

THE OWNER IS ALSO RESPONSIBLE FOR KNOWING EXACTLY WHAT HE IS PURCHASING.
