In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 3rd Floor of the Courthouse, in the Hon. Laurie J. Pittman's Courtroom in Ravenna, in the above named County, on Monday, April 27, 2009, at 12:00 P.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Franklin to-wit:

Situated in the Township of Franklin, County of Portage, Ohio:

Being part of said Township Lot 39 and more fully described as follows:

Beginning at a track spike buried in asphalt found monumenting the intersection of the centerlines of Lake Rockwell Road, (T.H. 154-A) and Brady Lake Road (C.H. 162-A; 40 feet wide); thence with the centerline of said Brady Lake Road S. 74 deg. 38' 00" W., 298.23 feet to an angle point on said road centerline; thence continuing S. 71 deg. 45' 00" E., 36.72 feet to a point and the true place of beginning for the parcel herein to be conveyed; thence continuing with said road centerline S. 71 deg. 45' 00" W., 51.45 feet to a point; thence with East and South line of lands of Childester (O.R. 159, P. 764) the following:

N. 18 deg. 15' 00" W., 220.00 feet to a No. 4 rebar set capped "6023" and passing over a No. 4 rebar, capped "6023" set 40 feet from said road centerline at the North line of an existing utilities easement; thence N. 71 deg. 45' 00" E., 108.11 feet to a 1" diameter iron pipe found; thence with a West line of lands of BLS Properties, Ltd (O.R. 378, P. 587) S. 3 deg. 48' 27" E., 227.18 ft. to the true place of beginning and passing over a No. 4 rebar set on the North line of said utilities easement and 41.31 feet from said true place of beginning. Containing 0.4029 acres of land, be the same, more or less, but subject to all legal highways, easements, and limitations of record, if any, as surveyed and determined from local records and monumentation in February, 2001, by Douglas E. Bedore, P.S. 6023, of Bedore Surveying, Inc. All bearing are to an assumed meridian, and are used to form angles only.

Said Premises Appraised at $75,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid, cash or check, payable to the Portage County Sheriff is required at the time the bid is accepted. The balance of Purchase Price shall be paid within thirty (30) days after the date of sale.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
