In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 3rd Floor of the Courthouse, in the Hon. Laurie J. Pittman's Courtroom in Ravenna, in the above named County, on Monday, March 9, 2009, at 12:00 P.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Suffield to-wit:

Known as and being part of Lot 17, further bounded and described as follows:

Commencing at a 1" rod in a monument box found this survey at the Northeast corner of Lot 17;

Course 1: Thence South 00 deg. 01 min. 12 sec. West, along the East line of Lot 17 and the centerline of Congress Lake Road, T.H. 17, 60 feet wide, a distance of 314.19 feet to a mag nail set flush this survey;

Course 2: Thence North 89 deg. 58 min. 48 sec. West, through the Grantors land and passing through a #5 rebar and I.D. Cap #6541 set flush this survey at 30.00 feet from centerline, a total distance of 278.41 feet to a #5 rebar and I.D. Cap #6541 set flush this survey;

Course 3: Thence North 00 deg. 23 min. 00 sec. East, a distance of 313.92 feet to a mag nail set flush this survey in the North line of Lot 17 and the centerline of Randolph Road C.H. 10, 60 feet wide (witness a #5 rebar and I.D. Cap #6541 set flush, South 00 deg. 23 min. 00 sec. West, a distance of 30.00 feet from mag nail set);

Course 4: Thence North 89 deg. 57 min. 47 sec. East, along a North line of Lot 17 and the centerline of Randolph Road, a distance of 276.42 feet to the place of beginning and containing 2.0000 acres of land, but subject to all legal highways, rights and easements of record as surveyed in November 1999 by John W. Patrick, Jr., Professional Land Surveyor #6541. The bearing of South 00 deg. 01 min. 12 sec. West, along the East line of Lot 17 as shown on Survey Plat P-8174 was used as the "BASIS OF BEARINGS" for this survey.

Said Premises Located at 2243 Congress Lake Rd., Mogadore, OH 44260.

Said Premises Appraised at $155,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid, cash or check, payable to the Portage County Sheriff is required at the time the bid is accepted. The balance of Purchase Price shall be paid within thirty (30) days after the date of sale.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
