In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 3rd Floor of the Courthouse, in the Hon. Laurie J. Pittman's Courtroom in Ravenna, in the above named County, on Monday, March 2, 2009, at 12:00 P.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the City of Kent to-wit:

PARCEL ONE:

Situated in the City of Kent, County of Portage and State of Ohio:

And known as being part of Great Lot No. 31, Subdivision No. 49, as recorded in Plat Book No. 4, Page 22, of the Portage County Records of Plats, and more particularly described as follows:

Beginning at an iron pipe in the North line of Grant Street (a 45 foot street) at the Southeast corner of Sublot No. 1297 of Mason Housing Company Allotment No. 1, as platted and recorded in Plat Book 4, Page 22; thence N. 24 deg. 29' E., along the East side of Sublot No. 1297 (and beyond), for a distance of 104.20 feet to an iron pipe; thence S. 65 deg 20' E., for a distance of 211.89 feet to an iron pipe in the West line of Subdivision No. 50; thence S. 57 deg. 10" W., along the West line of Subdivision No. 50 for a distance of 126.48 feet to an iron pipe found in the North line of Grant Street; thence N. 64 deg. 21' W., along the North line of Grant Street for a distance of 143.55 feet to the place of beginning and found to contain 0.4312 acres of land as surveyed by Lucius F. Converse, Serial No. 1199 in August, 1954.

EXCEPTING THEREFROM THE FOLLOWING:

And kown as being part of Original Franklin Township Lot No. 31 and further being known as a part of the so-called Subdivision No. 49 in the Mason Housing Company Allotment a recorded in Plat Book 4, Page 22 of the Portage County Records of Plats, and further described as follows:

Beginning at an iron pipe set in the North line of Grant Street at the Southeast corner of Sublot No. 1297 in the said Mason Housing Company Allotment; thence along the North line of Grant Street S. 64 deg. 21' E., a distance of 90.00 feet to an iron pipe set which is the true place of beginning for the following parcel of land; thence N. 24 deg. 29' 34" E., a distance of 105.75 feet to an iron pipe set in the North line of Subdivision No. 49; thence along the said North line S. 65 deg. 20' E., a distance of 121.89 feet to an iron pipe found; thence S. 57 deg. 11' 44" W., a distance of 126.51 feet to a point in the North line of Grant Street; thence along the North line of Grant Street N. 64 deg. 21' W., a distance of 53.55 feet to the true place of beginning and containing 0.214 acre of land, be the same more or less, but subject to all legal highways, as surveyed in September, 1980 by Donald Trocchio, Registered Surveyor No. 6445.

And known as being part of Original Franklin Township No. 31, and further being known as a part of the so-called Subdivision No. 49 in the Mason Housing Company Allotment as recorded in Plat Book 4, Page 22 of the Portage County Records of Plats, and further described as follows:

Beginning at an iron pipe set in the North line of Grant Street at the Southeast corner of Sublot No. 1297 in the said Mason Housing Comany Allotment; thence along the North line of Grant Street S. 64 deg. 21' E., a distance of 90.00 feet to an iron pipe set which is the true place of beginning for the following parcel of land; thence N. 24 deg. 29' 34" E., a distance of 105.75 feet to an iron pipe set in the North line of Subdivision No. 49; thence along the said North line S. 65 deg. 20' E., a distance of 121.89 feet to an iron pipe found; thence S. 57 deg. 11' 44" W., a distance of 126.51 feet to a point in the North line of Grant Street; thence along the North line of Grant Street, N. 64 deg. 21' W., a distance of 53.55 feet to the true place of beginning, and containing 0.214 acres of land, be the same more or less, but subject to all legal highways as surveyed in September, 1980 by Donald Trocchio, Registered Surveyor No. 6445.

Said Premises Located at 311 E. Grant St., Kent, OH 44240.

Said Premises Appraised at $115,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid, cash or check, payable to the Portage County Sheriff is required at the time the bid is accepted. The balance of Purchase Price shall be paid within thirty (30) days after the date of sale.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
