In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 3rd Floor of the Courthouse, in the Hon. Laurie J. Pittman's Courtroom in Ravenna, in the above named County, on Monday, February 23, 2009, at 12:00 P.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Freedom to-wit:

And being further described as follows:

Commencing at a railroad spike found at the intersection of the centerline of Nichols Rd. (C.H. 225) and Hudson Braceville Rd. (S.R. 303) (S.H. 648), said point also being the Southeasterly corner of Lot 45; thence West along the centerline of S.R. 303 and the Southerly line of Lot 45, a total distance of 604.72 feet to a point on said line, said point being the true place of beginning for this survey; thence continuing West along the centerline of S.R. 303 and the Southerly line of Lot 45, a total distance of 471.50 feet to a point on said line; thence N. 0" 05' E., along the Easterly property line of land now or formerly owned by Timothy J. Paul, passing over an iron pin 33.0 feet from the centerline of S.R. 303, a total distance of 208.55 feet to an iron pin at the Northwesterly corner of the Grantors property; thence S. 89 degrees 55' E., along the Southerly property line of two parcels of land now or formerly owned by Timothy J. Paul and John and Delano Orsini, a total distance of 471.50 feet to an iron pin on said line and the Westerly property line of land now or formerly owned by Arlene Gilbero; thence S. 0 degrees 05' W., along the Westerly property line of land now or formerly owned by Arlene Gilberto and passing over an iron pin 33.86 feet front the centerline of S.R. 303, a total distance of 207.86 feet to the true place of beginning for this survey and containing 2.254 acres of land as surveyed in December 1975 by Floyd L. Thomas and Samuel C. Janka, Reg. Surveyors No. 5461 and 5739 of the State of Ohio. Said parcel being a part of Lot 45 and subject to all easements of records.

Located in Lot 45, Freedom Township, Portage County, Ohio, and bounded and described as follows:

Beginning at the intersection of the centerline of Nichols Road (CH-225) and Hudson-Braceville Road (SR-303); thence West along the centerline of Hudson-Braceville Road, 840.47 feet to a point, the true point of beginning for the following described premises; thence continuing West, along the centerline, 235.75 feet to a point; thence N-0 degrees 05' E., along the East line of lands now owned by Margareet L. Paul, passing over an iron pipe at 33.00 feet, a total distance of 208.55 feet to an iron pipe; thence S-89 degrees 55'-W., passing over an iron pipe at 175.21 feet, a total distance of 208.21 feet to the true place of beginning and containing 1.1278 acres of land as surveyed in September ,1994, by Donald D. Harvey, Registered Surveyor No. 4112. Be the same more or less, but subject to all legal highways.

TERMS OF SALE: Cash.

A deposit of 10% of your bid, cash or check, payable to the Portage County Sheriff is required at the time the bid is accepted. The balance of Purchase Price shall be paid within thirty (30) days after the date of sale.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
