In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 3rd Floor of the Courthouse, in the Hon. Laurie J. Pittman's Courtroom in Ravenna, in the above named County, on Monday, February 23, 2009, at 12:00 P.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Village of Windham to-wit:

And known as being part of Windham Township Lot 58. Beginning at a point at the Southeast corner of Sublot 222 of Windham Estates No. 2 as recorded in Plat Book 20, Page 17 of the Portage County Records; thence South 88 deg. 59' 50 East along the Southerly line of said Sublot 222 of Windham Estates No. 2, a distance of 5.74 feet to a point; thence South 00 deg. 27' 05 West, a distance of 235.50 feet to a point on the Northerly right of way line of East Center Street (S.R. 303, 66 foot right of way); thence North 66 deg. 59' 50 West along said right of way line of East Center Street, a distance of 5.74 feet to a point on the Easterly right of way line of Spring Drive (50 foot right of way); thence North 00 deg. 27' 05 along said Easterly right of way line of said Spring Drive a distance of 235.50 feet to the beginning and containing 0.031 acres of land as surveyed by Dennis G. Hensley, Registered Surveyor No. S-5962, June 1975. Be the same more or less, but subject to all legal highways.

Beginning at a point at the Southeast corner of Sublot 16 of Windham Estates No. 1 as recorded in Plat Book 20, Page 2 of the Portage County Records, said point also on the Westerly right of way line of Spring Drive, 50 foot right of way; thence South 00 deg. 27' 05 West along said Westerly right of way line of Spring Drive, a distance of 210.97 feet to a point; thence 39.51 feet along the arc of a curve to the right, said curve having a central angle of 90 deg. 33' 05, a radius of 25.00 feet, a tangent of 25.24 feet and a chord of 35.53 feet, bearing South 45 deg. 43' 37 West to a point on the Northerly right of way line of East Center Street, a distance of 18.62 feet to a point; thence North 00 deg. 27' 05 East, a distance of 235.10 feet to a point in the Southerly line of said Sublot 16 of Windham Estates No. 1; thence North 89 deg. 32' 55 East along said Southerly line of said Sublot 16, a distance of 43.86 feet to the beginning and containing 0.234 acres of land, as surveyed by Dennis G. Beginning at the Southwest corner of Lot No. 58 and the center of State Route 303; thence South 89 deg. 35' East, along the South line of said Lot 58 and the center of State Route 303, 756.60 feet to a point, said point being the principal place of beginning for the following conveyance; thence North 0 deg. 07' West and passing over an iron pipe set thirty feet at side of highway, 268.50 feet to an iron pipe; thence South 89 deg. 35' West, 98.00 feet to an iron pipe; thence South 0 deg. 07' East, 268.50 feet and passing over an iron pipe set thirty feet at side of highway to the South line of Lot No. 58 and the center of State Route 303; thence North 89 deg. 35' East, along the center of said State Route 303, 98.00 feet to a point, said point being the principal place of beginning and containing .60 acres of land as surveyed by C. B. Dodge, Registered Surveyor. Be the same more or less, but subject to all legal highways.

Said Premises Located at 9839 East Center Street, Windham, OH 44288.

Said Premises Appraised at $60,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid, cash or check, payable to the Portage County Sheriff is required at the time the bid is accepted. The balance of Purchase Price shall be paid within thirty (30) days after the date of sale.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
