In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 3rd Floor of the Courthouse, in the Hon. Laurie J. Pittman's Courtroom in Ravenna, in the above named County, on Monday, January 12, 2009, at 12:00 P.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Rootstown to-wit:

Situated in the Township of Rootstown, County of Portage and State of Ohio:

Also known as being part of Lot 38 of said township and more fully described as follows:

Beginning at a point on the intersection of the centerlines of C.H. 82 (Old Forge Road) and T. H. 102 (Biltz Road);

1. Thence with the centerline of said Biltz Road and following North 0 deg. 11' 03" East, 1834.07 feet to an angle point in said centerline; North 21 deg. 03' 00" East, 1002.87 feet to an angle point in said centerline, North 20 deg. 42' 57" East, 819.45 feet to a point and the true place of beginning for the parcel herein to be conveyed;

2. Thence with additional lands presently held by C. and P. Greathouse the following, North 88 deg. 48' 55" West, 296.19 feet to an iron pin set and passing over a spike found in the root of a twin 12" walnut, said spike being 31.64 feet from said road centerline, North 1 deg. 11' 01" East, 198.78 feet to an iron pin set;

3. Thence with a South line of lands now held by J. & C. Valarinos, South 88 deg. 47' 58" East, 366.67 feet to a point on the centerline of Biltz Road and passing from centerline of Biltz Road and passing over a spike set in the root system of a 24" maple and 31.64 feet from said centerline;

4. Thence with said centerline of Biltz Road, South 20 degrees 42' 57" West, 210.81 feet to the true place of beginning. Containing 1.5121 acres of land, be the same more or less, but subject to all legal highways. As surveyed and determined in January-February, 1982, by Douglas E. Bedore, Registered Surveyor 6023.

Said Premises Appraised at $85,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid, cash or check, payable to the Portage County Sheriff is required at the time the bid is accepted. The balance of Purchase Price shall be paid within thirty (30) days after the date of sale.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
