In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 3rd Floor of the Courthouse, in the Hon. Laurie J. Pittman's Courtroom in Ravenna, in the above named County, on Monday, December 8, 2008, at 12:00 P.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Atwater to-wit:

Situated in the Township of Atwater, County of Portage and State of Ohio and further described as follows, to wit:

Beginning at the Northwest corner of Lot Number 24 in Atwater Township, Portage County, Ohio; thence South 85 degrees 33 minutes East along the North line of Lot Number 24 and passing over an iron pipe set 30.00 feet from the corner of the lot a distance of 180.00 feet to an iron pipe; thence South 4 degrees 30 minutes West, a distance of 85.00 feet to an iron pipe; thence North 85 degrees 33 mintues West and passing over an iron pipe set 30.00 feet from West line of Lot 24, a distance of 180.00 feet to a point on the lot line; thence North 4 degrees 30 minutes East along the West line of Lot 24 which is also the center line of C.H. 54, Section A and known as the Porter-Shilliday Road, a distance of 85.00 feet to the place of beginning and containing 0.351 acres of land as surveyed by Paul C. Shafer, Registered Surveyor, Number 510.

Known as being a part of Great Lot No. 23, (Tp. 1N, R 7W) Atwater Township, Portage County, Ohio, bounded and described as follows:

Beginning for the same in the center of the Porter-Shilliday Road C.H. 54, Section A and the Southwest as follows:

Beginning for the same in the center of the Porter-Shilliday Road C.H. 54, Section A, and the Southwest corner of Great Lot 23; thence North 4 deg. 30' East along the center of the said road and the West line of the said great lot 115.0 feet; thence South 85 deg. 33' East and passing over an iron pin 30.0 feet East of the center of the said road 235.0 feet to an iron pin; thence South 4 deg. 30' West, 115.0 feet to an iron pin; thence North 85 deg. 33' West, and passing over an iron pin 30.0 feet East of the center of the said road, 235.0 feet to the place of beginning and containing 0.62 acres of land, be the same more or less, but subject to all legal highways as surveyed by W. D. Sponseller, Registered Surveyor No. 914.

Said Premises Appraised at $85,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid, cash or check, payable to the Portage County Sheriff is required at the time the bid is accepted. The balance of Purchase Price shall be paid within thirty (30) days after the date of sale.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
