In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 3rd Floor of the Courthouse, in the Hon. Laurie J. Pittman's Courtroom in Ravenna, in the above named County, on Monday, November 24, 2008, at 12:00 P.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Atwater to-wit:

Situated in the Township of Atwater, County of Portage and State of Ohio and known as:

Beginning at the Northeast corner of Lot 72 of the original plat of Atwater Station; thence S. 0 deg. 06' W., along the West line of T.H. 43 known as Bank Street, a distance of 370.30 feet to an iron pipe found and the true place of beginning; thence S. 2 deg. 10' W., a distance of 179.54 feet to an iron pipe found marking the Northeast corner of the Wilson property; thence S. 98 deg. 48' 15" W., along Wilson's North line a distance of 263.53 feet to a point in the East right-of-way line of the C&P Railroad witnessed by an iron pipe found S. 88 deg. 45' 15" W. and 1.80 feet distant from said point; thence N. 21 deg. 23' 30" W., along the aforementioned C&P Railroad right-of-way line, a distance of 197.31 feet to an iron pipe found; thence N. 89 deg. 45' E., a distance of 342.19 feet to the true place of beginning and containing 1.266 acres of land as surveyed by Paul C. Shafer, Registered Surveyor No. 510 said parcel being a portion of land deeded out of a certain tract of land deeded the Grantor as recorded in Volume 399, Page 110, of the Portage County Record of Deeds.

Beginning at the Northeast corner of Lot 72 of the original plat of Atwater Station; thence S. 0 deg. 06' W., along the West line of T.H. #43 known as Bank Street, a distance of 370.30 feet to an iron pipe found at the Southeast corner of the Winters property which is the true place of beginning; thence continuing S. 0 deg. 06' W., along the West line of Bank Street, a distance of 11.00 feet to an iron pipe; thence N. 86 deg. 44' W., a distance of 178.03 feet to an iron pipe; thence N. 89 deg. 45' E., along the South line of the property now owned by Winters, a distance of 177.75 feet to the place of beginning and containing 0.022 acres of land as surveyed by Paul C. Shafer, Registered Surveyor No. 510. Subject to conditions, restrictions, limitations, rights, coventants, agreements and easements of record, if any.

Said Premises Appraised at $65,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid, cash or check, payable to the Portage County Sheriff is required at the time the bid is accepted. The balance of Purchase Price shall be paid within thirty (30) days after the date of sale.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
