In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 3rd Floor of the Courthouse, in the Hon. Laurie J. Pittman's Courtroom in Ravenna, in the above named County, on Monday, November 10, 2008, at 12:00 P.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Palmyra to-wit:

PARCEL I:

And known as being part of Lot 24 of Division 4 in said township and further bounded and described as follows:

Beginning at an angle point in the centerline of Whippoorwill Road (TH-129) said point being South 87 deg. 20' West, a distance of 348.75 feet from the centerline intersection of said Whippoorwill Road and McClintocksburg Road; thence South 85 deg. 38' West, along said centerline of Whippoorwill Road a distance of 621.10 feet to the Northwest corner of land now or formerly owned by Mildred K'Meyer and the true place of beginning for the parcel herein described; thence due South along the West line of said K'Meyer's land, a distance of 505.20 feet to an iron pin found at the Southwest corner of said K'Meyer's land; thence South 85 deg. 38' West, along the North line of land now or formerly owned by E. & S. Tomlinson, a distance of 51.93 feet to an iron pin; thence due North, and passing over an iron pin at 475.11 feet, a distance of 505.20 feet to a point on the centerline of said Whippoorwill Road; thence North 85 deg. 38' East, along said road centerline, a distance of 51.93 feet to a point and the true place of beginning and containing therein 0.601 acres of land as surveyed in August, 1979, by Jerry W. Daniel, Registered Surveyor #6222.

Known as being part of Lot No. 24, Division 4 of lots in said township, more fully described as follows, to wit:

Beginning in the centerline of Township Highway No. 129, S. 87 deg. 20' W., 348.75 feet and S. 85 deg. 38' W., 535.10 feet from the intersection of said TH-129 and County Highway No. 135, said CH-135 centerline being the East line of said Lot No. 24, Div. 4; thence continuing along the centerline of said TH-129, S. 85 deg. 38' W., 86.00 feet; thence South (passing over an iron pipe at 30.10 feet) 505.20 feet to an iron pipe; thence N. 85 deg. 38' E., 86.00 feet to an iron pipe; thence North (passing over an iron pipe at 475.10 feet) 505.20 feet to the place of beginning and containing 1.000 acres of land as surveyed in July 1953, by Leo E. Martin, Reg. Sur. No. 2587, be the same more or less, but subject to all legal highways.

Beginning at a point in the Easterly line of said Lot 24, Division 4 at the intersection of the centerline of CH-135, McClintocksburg Road and TH-129 Whippoorwill Road; thence S. 87 deg. 20' 00" W., along the centerline of TH-129, a distance of 349.00 feet to a point; thence S. 85 deg. 27' 00" W., continuing along the centerline of TH-129, a distance of 363.10 feet to a point at the Northwesterly corner of land now or formerly owned by Alan C. Tomlinson; thence S. 00 deg. 13' 00" E., along the Westerly line of said Alan C. Tomlinson, a distance of 252.73 feet to a point in the Southeasterly corner of land now or formerly owned by H. E. and B. A. Browning which marks the true place of beginning for the following described parcel of land; thence continuing S. 00 deg. 13' 00" E., along the Westerly line of said Alan C. Tomlinson, a distance of 252.72 feet to an iron pipe set; thence S. 85 deg. 26' 22" W., a distance of 173.14 feet to an iron pipe found at the Southeasterly corner of land now owned by Mildred K'Meyer; thence N. 00 deg. 16' 55" W., along the Easterly line of said K'Meyer, a distance of 252.99 feet to an iron pipe found at the Southwesterly corner of the aforementioned Browning; thence N. 85 deg. 32' 05" E., along the Southerly line of said Browning, a distance of 173.41 feet to the true place of beginning, containing 1.003 acres of land, more or less, as surveyed July 27, 1981 by Al Szuch & Association, Reg. Sur. No. 5398.

TERMS OF SALE: Cash.

A deposit of 10% of your bid, cash or check, payable to the Portage County Sheriff is required at the time the bid is accepted. The balance of Purchase Price shall be paid within thirty (30) days after the date of sale.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
