In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 3rd Floor of the Courthouse, in the Hon. Laurie J. Pittman's Courtroom in Ravenna, in the above named County, on Monday, September 22, 2008, at 12:00 P.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Atwater to-wit:

Situated in the Township of Atwater, County of Portage and State of Ohio:

And being a parcel of land located in the Southeast center lot, Atwater Township, Portage County, State of Ohio, and being recorded in Volume 1019, Page 522, basis of bearing from Plat No. P11476 and being further described as follows:

Commencing at a railroad spike found at the Southwest corner of the Southeast center lot; thence South 89 degrees 57' 51" East, along the Southerly line of the Southeast center lot, a distance of 30.0 feet to a 5/8" rebar with Cap No. 5451-5739 set, said point being the true place of beginning for this survey; thence North 0 degrees 00" West along the Easterly right of way line of State Route 183 (Edinburg-Alliance Road), a distance of 304.67 feet to a 5/8" rebar with Cap No. 5451-5739 set on said line at the Southwesterly property corner of land now or formerly owned by C. J. and J. L. Jones; thence South 89 degrees 55", 53" East along the Southerly property line of land now or formerly owned by C. J. and J. L. Jones, a distance of 200.45 feet to a 5/8" rebar set with Cap No. 5461-5739 set 1' West at the Southeast corner of said land, said point being on the Westerly property line of land now or formerly owned by M. L. or D. A. Lanham; thence S. 0 degrees 13' 14" W., a distance of 304.84; thence North 89 degrees 52' 51" West, along the Southerly line of the Southeast center lot, a distance of 199.28 feet to the true place of beginning for this survey and containing 1.398 acres of land as surveyed in Sept. 1999 by Floyd L. Thomas and Samuel C. Janka, Reg. Surveyors No. 5461 and 5739 of the State of Ohio.

Said Premises Located at 1046 State Route 183, Atwater, Ohio 44201.

Said Premises Appraised at $75,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid, cash or check, payable to the Portage County Sheriff is required at the time the bid is accepted. The balance of Purchase Price shall be paid within thirty (30) days after the date of sale.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
