In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 3rd Floor of the Courthouse, in the Hon. Laurie J. Pittman's Courtroom in Ravenna, in the above named County, on Monday, July 28, 2008, at 12:00 P.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Palmyra to-wit:

Being a parcel of land located in Lots 28 and 30, Div. 3 East, Palmrya Township, Portage County, State of Ohio, and being recorded in Volume 1119, Page 817, basis of bearing from Plat No. P7341, and further described as follows:

Commencing at an iron pin found on the centerline of Tallmadge Rd. (C.H. 18), said point being the Southeasterly corner of Lot 28 and the Southwesterly corner of Lot 30, said point being the true place of beginning for this survey and being further described as follows. Thence South 89 deg. 22' 55" West, along the centerline of Tallmadge Road (C.H. 18), a distance of 30.00 feet to a railroad spike found; thence North 0 deg. 37' 05" West, along the Easterly property line of land now or formerly owned by K. E. Gregory and J. S. Baird, a distance of 210.00 feet to an iron pin found with cap no. (R.C. Fleet 6600) at the Northeasterly corner of said land; thence South 89 deg. 22' 55" West, along the Northerly property line of land now or formerly owned by K. E. Gregory and J. S. Baird, a distance of 50.00 feet to a point at the Northwesterly corner of said land; thence South 0 deg. 37' 05" East, along the Westerly property line of land now or formerly owned by K. E. Gregory and J.S. Baird, a distance of 210.00 feet to a point on the centerline of Tallmadge Rd. (C.H. 18); thence South 89 deg. 22' 55" West, along the centerline of Tallmadge Rd. a distance of 41.50 feet to a point on said centerline; thence North 0 deg. 37' 05" West, along the Easterly property line of land now or formerly owned by L. M. Davis and A. Morgan nka A. Davis, a distance of 210.00 feet to a point at the Northeasterly corner of said land; thence South 89 deg. 22' 55" West, along the Northerly property line of land now or formerly owned by L. M. Davis and A. Morgan nka A. Davis, a distance of 45.50 feet to the Northwesterly corner of said land said point being on the Easterly right of way line of Depot St.; thence North 0 deg. 37' 05" West, along the Easterly right of way line of Depot St., a distance of 160.00 feet to a point on the centerline of vacated Mason St.; thence North 89 deg. 22' 55" East, along the centerline of vacated Mason St. and passing over the lot line between Lots 28 and 30 at 167.00 feet, a distance of 197.00 feet to a point on the Westerly property line of land owned by the State of Ohio; thence South 0 deg. 37' 05" East, along the Westerly property line of the State of Ohio, a distance of 370.00 feet to a railroad spike found on the centerline of Tallmadge Rd. (C.H. 18); thence South 89 deg. 22' 55" West, along the centerline of Tallmadge Rd. (C.H. 18), a distance of 30.00 feet to the true place of beginning for this survey and containing 1.2129 acres of land of which 0.9581 acres are in Lot 28 and 0.2548 acres are in Lot 30 as surveyed in Aug. 1999 by Floyd L. Thomas and Samuel C. Janka, Reg. Surveyors No. 5461 and 5739 of the State of Ohio.

Note:

Legal description in Quit-Claim Deed, Instrument 200513639, contains several scivener's errors: should be "Thence South 89 deg. 22' 55" West" instead of "22' 66" West"; "L.M. David and A. Morgan" instead of "A. Florgan"; "at the Northeasterly corner of said land" instead of "Northerly"; "South 89 deg. 22' 55" West" instead of "22' 55" West"; and has omitted text: Northwesterly corner of said land said point being". Said errors do not materially affect the integrity or insurability of the transfer of title to the Grantee.

Said Premises Located at 4034 Depot St., Diamond, OH 44412-8713.

Said Premises Appraised at $80,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid, cash or check, payable to the Portage County Sheriff is required at the time the bid is accepted. The balance of Purchase Price shall be paid within thirty (30) days after the date of sale.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.

THE OWNER IS ALSO RESPONSIBLE FOR KNOWING EXACTLY WHAT HE IS PURCHASING.
