In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 3rd Floor of the Courthouse, in the Hon. Laurie J. Pittman's Courtroom in Ravenna, in the above named County, on Monday, June 9, 2008, at 12:00 P.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the City of Kent to-wit:

The land referred to in this commitment is described as follows:

PARCEL NO. 1:

Situated in the City of Kent County of Portage and State of Ohio, and known as being part of Brimfield Township Lot No. Two (2) and further described as follows:

Beginning at a point in the North line of Brimfield Township Lot No. Two (2) and being S. 89 deg. 42 min. West, 400.00 feet from a monument at the intersection of said North lot line with the centerline of Mogadore Road; thence S. 20 deg. 42 min. West, 94.32 feet along the West line of H. & D. Fogle to an iron rod in the North right-of-way kube of State 281; thence N. 88 deg. 17 min. West, 1059.49 feet along said right-of-way line to an iron rod in the Grantors West line; thence N. 0 deg. 18N min. East, 14.50 feet to an iron rod in the North line of Lot No. Two (2); thence N. 89 deg. 61 min. 18 sec. East, 242.74 feet along said North lot line to a marked stone; thence N. 89 deg. 42 min. East, 847.78 feet along said North lot line to the place of beginning. Containing 1.272 acres of land, be the same more or less, but subject to all legal highways. Beginning at a stone at the Southwest corner of Franklin Township Lot No. Eight (8) and being in the North line of Brimfield Township Lot No. Two (2); thence N. 88 deg. 42 min. East, 462.58 feet along the township line to an iron pipe; thence S. 0 deg. 18 min. East, 82.87 feet to the North right-of-way line of State Route 261; thence N. 88 deg. 17 min. West, 697.19 feet along said North right-of-way line to the Grantors Southwest corner; thence N. 0 deg. 18 min. East 14.50 feet to an iron rod at the Grantors Northwest corner and being in the North line of Brimfield Township Lot No. Two (2); thence N. 89 deg. 51 min. 18 sec. East, 242.74 feet along the townhip line to the beginning. Containing 0.613 of an acre of land, be the same more or less, but subject to all legal highways.

Beginning at a monument found at the intersection of Mogadore Road with the North line of Brimfield Lot 2; thence with the North line of Lot 2 South 89 deg. 52 min. 47 sec. West, 614.46 feet to an iron rod found at the corner of S/L 13R (Kent Industrial Park) which is the true place of beginning; thence South 0 deg. 11 min. 00 sec. East, 76.35 feet to a 1/2 inch pipe set on the North line of St. Rt. 261; thence with said line North 88 deg. 08 min. 08 sec. West, 178.83 feet to a point at the corner of S/L 13R; thence along S/L 13R N. 0 deg. 07 min. 13 sec. West, 62.84 feet to a point; thence N. 89 deg. 52 min. 47 sec. East, 178.11 feet to the place of beginning. Containing 0.2825 acres of land.

PARCEL NO. 2:

Situated in the City of Kent, County of Portage and State of Ohio, and known as being a parcel of land in Brimfield Township Lot No. Two (2) and bounded and described as follows:

Beginning at a point in the center of the North and South Road (County Road No. 7) where Franklin and Brimfield town line crosses; thence S. 88 deg. 56 min. West, along the town line 400.00 feet to an iron pipe and passing thence over an iron pipe 32.13 feet from the above mentioned road center; thence S. 19 deg. 56 min. West, 115.10 feet to an iron pipe; thence N. 88 deg. 56 min. East, 400.00 feet to the center of said road and passing over an iron pipe 32.12 feet from said road center; thence N. 19 deg. 56 min. East, along road center 115.10 feet to the place of beginning and containing 1.057 acres of land, be the same more or less, but subject to all legal highways. Excepting therefrom the following three (3) tracts of land conveyed to the State of Ohio for highway purposes, as recorded in Volume 894, Pages 992-993, Portage County Recorders Office, Deed Records, and more specifically described as follows:

TRACT 1:

Situated in the City of Kent, County of Portage and State of Ohio:

Commencing at a point of intersection of the North line of Lot No. Two (2), same being the Northerly line of said Brimfield Township, with the existing centerline of Mogadore Road; thence S. 20 deg. 42 min. 00 sec. West, along said existing centerline, a distance of 83.08 feet to a point on centerline, same being the Easterly property line of the owners, the place of beginning of this described parcel; thence along said centerline and Easterly property line S. 20 deg. 42 min. 00 sec., West a distance of 32.02 feet to the Southeast property corner; thence S. 89 deg. 42 min. 00 sec. West, along the Southerly property line, a distance of 66.29 feet to a point; thence S. 89 deg. 18 min. 00 sec. East, a distance of 47.93 feet to the place of begining, containing 0.054 of an acre of land of which 0.030 of an acre is to be acquired and 0.024 of an acre is within the existing highway right of way. Description for the above parcel is based on a survey made by Clifton M. Newhall, Registered Surveyor No. 2864, be the same more or less, but subject to all legal highways.

Situated in the City of Kent, County of Portage and State of Ohio:

Beginning at the Northeast property corner of the owners same being the intersection of the existing centerline of Mogadore Road with the Northerly line of Brimfield Township and Lot No. Two (2); thence S. 20 deg. 42 min. 00 sec. West, along said centerline and owners Easterly property line, a distance of 83.08 feet to a point on a proposed limited access line of S.R. 261; thence N. 89 deg. 18 min. 00 sec. West, along limited access line, a distance of 47.93 feet to a point; thence N. 34 deg. 45 min. 43 sec. East, along a proposed Westerly right-of-way line of Mogadore Road, a distance of 73.76 feet to a point on the existing West line of Mogadore Road, said point intersecting with the aforesaid Northerly lot line, and township line; thence S. 89 deg. 55 min. 21 sec. East, along said lot line and township line, same being the Northerly property line, a distance of 32.13 feet to the place of beginning, containing 0.068 of an acre of land which 0.016 of an acre is to be acquired and 0.053 of an acre is within the existing highway right-of-way. Description for the above parcel is based on a survey made by Clifton M. Newhall, Registered Surveyor No. 2684, be the same more or less, but subject to all legal highways.

Commencing at the owners' Northeast property corner, same being the intersection of the North line of Brimfield Township and the North line of Lot No. Two (2), with the existing centerline of Mogadore Road; thence S. 20 deg. 42 min. 00 sec. West, along said centerline, same being the Easterly property line, a distance of 115.10 feet to the Southeast property corner; thence S. 89 deg. 42 min. 00 sec. West, along the Southerly property line, a distance of 116.19 feet to a point on property line 115.00 feet left of centerline survey Station 51 plus 45.22, (S.R. 261), the place of beginning of this described parcel; thence continuing along said Southerly property line, S. 89 deg. 42 min. 00 sec. West, a distance of 283.81 feet to a point at the Southwest property corner; thence N. 20 deg. 42 min. 00 sec. East, along the Westerly property line, a distance of 20.78 feet to a point; thence S. 86 deg. 17 min. 00 sec. East, along a proposed Northerly limited access line, a distance of 277.04 feet to the place of begining. Containing 0.053 of an acre of land, be the same more or less, but subject to all legal highways.

Said Premises Located at 5341 Mogadore Road, Kent, OH 44240.

Said Premises Appraised at $110,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid, cash or check, payable to the Portage County Sheriff is required at the time the bid is accepted. The balance of Purchase Price shall be paid within thirty (30) days after the date of sale.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
