In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 3rd Floor of the Courthouse, in the Hon. Laurie J. Pittman's Courtroom in Ravenna, in the above named County, on Monday, April 21, 2008, at 12:00 P.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Ravenna to-wit:

The land referred to in this commitment, situated in the Township of Ravenna, County of Portage, State of Ohio, is described as follows:

And known as being part of Lot 28, in said township and also known as being part of a parcel conveyed to L. Rich as recorded in Vol. 1030, Pg. 851 of the Portage County Records, and being more fully bounded and described as follows:

Beginning at a 3/4" iron bar at the center line intersection of New Milford Rd. (C.H. 131) and Hayes Road (C.H. 138) (66' R/W); thence N. 89 deg. 45' 10" E., 832.00' along the centerline of Hayes Rd., to the true place of beginning for the parcel hereinafter described (witness a 5/8 rebar w/cap set S. 02 deg. 07' 37" W., 32.86'); thence N. 89 deg. 45' 10" E., 220.77' containing along said center line to an angle point therein; thence S. 89 deg. 01' 33" E., 23.48' continuing along said center line to the Northeast corner of a parcel conveyed to J. H. or D. M. Petro (OR 469/229); thence S. 01 deg. 13' 06" W., 1014.63' (passing over a 5/8" rebar w/cap 5756 found 32.85' from said center line), along the Westerly line of said Petro parcel and the Westerly line of parcels conveyed to J. or P. Sandlin (OR 420/360) and S. A. or C. L. Kleski (OR 468/37), to a 5/8" rebar w/cap 5756 found in the South line of said Lot 28; thence S. 88 deg. 14' 03" W., 260.75' along the Southerly line of Lot 28, to a 5/8" rebar w/cap set; thence N. 02 deg. 07' 37" E., 1022.59' along a new division line to the true place of beginning and containing 5.899 acres of land more or less as determined from a survey made by Stephen P. Campbell, Professional Land Surveyor No. 7330 of Campbell & Associates, Inc. in February 2001. (C & A Project No. 20011032). The bearings used to prepare this description are based on the bearing of Hayes Rd. as recorded in Vol. 1030, Pg. 851 of the Portage County Records.

Said Premises Appraised at $120,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid, cash or check, payable to the Portage County Sheriff is required at the time the bid is accepted. The balance of Purchase Price shall be paid within thirty (30) days after the date of sale.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
