In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 3rd Floor of the Courthouse, in the Hon. Laurie J. Pittman's Courtroom in Ravenna, in the above named County, on Monday, April 21, 2008, at 12:00 P.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Randolph to-wit:

Situated in the Township of Randolph, County of Portage and State of Ohio:

Being part of Lot No. 61 in Randolph Township, Portage County and more fully described as follows:

Beginning at a stone in the Northwest corner of Lot No. 61; thence South 88 degrees 13 minutes East, along the North line of said Lot No. 61, a distance of 2896.83 feet to a point in the center line of a North and South Road, said point being the Northeast corner of Lot No. 61 and also being the true place of beginning; thence South 1 degree 20 minutes West, along said center line of road and the East line of Lot No. 61, a distance of 568.20 feet to a point; thence North 88 degrees 13 minutes West, 766.65 feet to a point; thence North 1 degree 20 minutes East, 568.20 feet to a point in the North line of Lot No. 61; thence South 88 degrees 13 minutes East, along the North line of Lot No. 61, 766.65 feet to the true place of beginning and containing ten acres of land, as surveyed by L. V. Bausher, License No. 2069, be the same more or less, but subject to all legal highways.

EXCEPTING from the above premises the following:

EXCEPTION NO. 1:

Situated in the Township of Randolph, County of Portage and State of Ohio:

A parcel of land situated in the Lot 61, Township of Randolph, County of Portage and State of Ohio and being further described as follows:

Beginning at the Northeast corner of Lot 61; thence South 1 degree 20 minutes West, along the East line of Lot 61, a distance of 130.00 feet to a point which is the true place of beginning. Beginning at said point; thence South 1 degree 20 minutes West, along said lot line a distance of 154.10 feet to a point; thence North 88 degrees 13 minutes West, a distance of 766.65 feet to an iron pin; thence North 1 degree 20 minutes East, a distance of 284.10 feet to an iron pin; thence South 88 degrees 13 minutes East, a distance of 263.65 feet to an iron pin; thence South 1 degree 20 minutes West, a distance of 130.00 feet to an iron pin; thence South 88 degrees 13 minutes East, a distance of 503.00 feet to the true place of beginning and containing 3.498 acres. Surveyed by Lowell A. Young, Re. Sur. No. 6225 on May 1, 1979.

EXCEPTION NO. 2:

Situated in the Township of Randolph, County of Portage and State of Ohio, and known as being part of Lot No. 61, township, county and state aforesaid and more particularly described as follows:

Beginning at an iron pipe at the Northeast corner of said Lot No. 61 which is also the centerline of Highway No. 47 (Cambellsport-Industry Road). This iron pipe is also in the East line of Randolph Township; thence South 01 degree 20 minutes West, along the East line of said Lot No. 61 and centerline of Highway No. 47 for a distance of 414.10 feet to an iron pin which marks the true place of beginning of the following described parcel of land. This true place of beginning is at the Southeast corner of a 2.288 acre parcel of land now owned by Raymond Murdock; thence North 88 degrees 13 minutes West, along the South side of said 2.288 acre parcel of land for a distance of 766.65 feet to an iron pin the East line of a parcel of land formerly owned by Albert Graff; thence South 01 degree 20 minutes West, along said Graff land for a distance of 154.10 feet to an iron pipe; thence South 88 degrees 13 minutes East, along the North side of a parcel of land now owned by F. C. Corl for a distance of 766.65 feet to a point in the East line of said Lot No. 61; thence North 01 degree 20 minutes East, along the East line of said Lot No. 61 and approximate centerline of Highway No. 47 for a distance of 154.10 feet to the true place of beginning and found to contain 2.712 acres of land as surveyed by Lucius P. Converse, Reg. Sur. No. 1199 in August, 1961.

EXCEPTION NO. 3:

Situated in the Township of Randolph, County of Portage and State of Ohio:

And known as being part of Lot No. 61, township, county and state of aforesaid and more particularly described as follows:

Beginning at an iron pipe at the Northeast corner of said Lot No. 61 which is also the centerline of Highway No. 47 (Campbellsport-Industry Road); this iron pipe is also in the East line of Randolph Township; thence South 1 degree 20 minutes West, along the East line of said Lot No. 61 and centerline of Highway No. 47 for a distance of 284.10 feet to a point which marks the true place of beginning of the following described parcel of land. This true place of beginning is at the Southeast corner of a 5.00 acre parcel of land now owned by Adolph Seidel; thence North 88 degrees 13 minutes West, along the South side of said 5.00 acre parcel of land for a distance of 766.65 feet to an iron pipe in the East line of a parcel of land formerly owned by Albert Graff; thence South 1 degree 20 minutes West, along said Graff land for a distance of 130.00 feet to an iron pin; thence South 88 degrees 20 minutes East for a distance of 766.65 feet to an iron pin in the East line of said Lot No. 61; thence North 1 degree 20 minutes East along the East line of said Lot No. 61 and approximate centerline of Highway No. 47 for a distance of 130.00 feet to the true place of beginning and found to contain 2.288 acres of land as surveyed by Lucius F. Converse, Reg. Sur. No. 1199 in August 1961.

Note:

Iron pins were found or set 30.00 feet Westwardly from the East line of said Lot No. 61 on both of the East and West lines. Be the same more or less, but subject to all legal highways.

Said Premises Appraised at $110,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid, cash or check, payable to the Portage County Sheriff is required at the time the bid is accepted. The balance of Purchase Price shall be paid within thirty (30) days after the date of sale.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
