In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 3rd Floor of the Courthouse, in the Hon. Laurie J. Pittman's Courtroom in Ravenna, in the above named County, on Monday, January 28, 2008, at 12:00 P.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Atwater to-wit:

The land referred to in this commitment, situated in the Township of Atwater, County of Portage, State of Ohio, is described as follows:

Situated in the Township of Atwater, County of Portage and State of Ohio and known as being a parcel of land located in Lot 120, Atwater Township, Portage County, State of Ohio, and being further described as follows:

Commencing at the intersection of the centerline of Laubert Road (T.H. 29) and Industry Road (C.H. 47) said point also being the Southwesterly corner of Lot 20; thence North along the centerline of Industry Road (C.H. 47) and the township line between Atwater and Randolph Township, a distance of 1408.57 feet to a point on said line, said point being the true place of beginning for this survey; thence continuing North along the centerline of Industry Road (C.H. 47), a distance of 177.82 feet to a point on said line; thence East along a line running through the Grantors property and passing over a iron pin at 30.00 feet from the centerline of Industry Road (C.H. 47), a distance of 435.60 feet to a point on the Westerly property line of land now or formerly owned by Paul W. and Evelyn R. Postal; thence South along the Westerly property line of land now or formerly owned by Paul W. and Evelyn R. Postal; thence South along the Westerly property line of land now or formerly owned by Paul W. and Evelyn R. Postal, a distance of 177.82 feet in a point on said line; thence West along the Northerly property line of land now or formerly owned by Paul W. and Evelyn R. Postal, a distance of 435.60 feet to the true place of beginning for this survey and containing 1.778 acres of land more or less, as surveyed in May 1979 by Floyd L. Thomas and Samuel C. Janka, Registered Surveyor No. 5461 and 5739 of the State of Ohio:

Situated in the Township of Atwater, County of Portage and State of Ohio and known as being a parcel of land located in Lot 120, Atwater Township, Portage County, State of Ohio and being further described as follows:

Commencing at the intersection of the centerlines of Laubert Road (T.H. 29) and Industry Road (C.H. 47) said point also being the Southwesterly corner of Lot 120; thence North along the centerline of Industry Road, (C.H. 47) and the township line between Atwater and Randolph Township, a distance of 1586.39 feet to a point on said line, said point being the true place of beginning for this survey; thence continuing North along the centerline of Industry Road, (C.H. 47) a distance of 161.09 feet to a point on said line; thence East along a line running through the Grantors property and passing over an iron pin at 30.00 feet from the centerline of Industry Road (C.H. 47) a distance of 435.60 feet to a point on the Westerly propery line of land now or formerly owned by Steve and Joan Toth; thence South along the Westerly property line of two parcels of land now or formerly owned by Steve and Joan Toth, and Paul W. and Evelyn R. Postal, a distance of 161.09 feet to a point on the Westerly property line of lands now or formerly owned by Paul W. and Evelyn R. Postal; thence West along a line running through the Grantors property, a distance of 435.60 feet to the true place of beginning for this survey and containing 1.611 acres of land as surveyed in March, 1979 by Floyd L. Thomas and Samuel C. Janka, Registered Surveyors No. 5461 and 5739 of the State of Ohio, subject to all easements of record.

Said Premises Located at 482 Industry Rd., Atwater, OH 44201-9771.

Said Premises Appraised at $140,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid, cash or check, payable to the Portage County Sheriff is required at the time the bid is accepted. The balance of Purchase Price shall be paid within thirty (30) days after the date of sale.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
