In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 3rd Floor of the Courthouse, in the Hon. Laurie J. Pittman's Courtroom in Ravenna, in the above named County, on Monday, September 24, 2007, at 12:00 P.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Village of Windham to-wit:

Situated in the Village of Windham, County of Portage and State of Ohio and known as part of Original Lot 46 of Windham Township and bounded and described as follows:

Commencing at a disc found in a monument box at the centerline intersection of East Center Street (S.R. 303) and South Main Street; thence South 0 deg. 14' 00" West, along the centerline of said South Main Street, a distance of 1159.14 feet to a point; thence North 89 deg. 20' 48" West, 30.00 feet to a point on the West line of said street and the Southeast corner of land conveyed to M. Davis by Volume 744, Page 87 of Portage County Record of Deeds, said point bearing South 35 deg. 27' 43" West, 0.20 feet from a 1/2" pipe found and said point being the true place of beginning for the parcel herein described; thence South 0 deg. 14' 00" West, along the West line of said South Main Street, a distance of 92.25 feet to a 5/8" capped rebar set at the Northeast corner of land conveyed to K. & B. Braden by Volume 1074, Page 632 of Portage County Record of Deeds; thence North 89 deg. 20' 48" West, along said Braden's North line, a distance of 275.00 feet to a 5/8" capped rebar set on the East line of land conveyed to I. & S. Ward by Volume 122, Page 115 of Portage County Official Records; thence North 0 deg. 14' 00" East, along said Ward's West line, a distance of 92.25 feet to a 5/8" capped rebar set on the South line of said Davis land; thence South 89 deg. 20' 48" East, along the North line of said Davis' land, a distance of 275.00 feet to the true place of beginning and containing 0.5824 acres of land as surveyed in January, 2005 by Clifford H. McGuire, Professional Surveyor No. 7770. Basis of bearing taken from Survey Plat P-14314. Deed of record was Volume 1131, Page 135 to K. & M. Allen. Monuments set were 5/8" x 30" rebars set and capped (C.H. McGuire, P.S. 7770).

Said Premises Appraised at $85,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid, cash or check, payable to the Portage County Sheriff is required at the time the bid is accepted. The balance of Purchase Price shall be paid within thirty (30) days after the date of sale.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
