In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 3rd Floor of the Courthouse, in the Hon. Laurie J. Pittman's Courtroom in Ravenna, in the above named County, on Monday, September 24, 2007, at 12:00 P.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Brimfield to-wit:

Situated in the Township of Brimfield, County of Portage and State of Ohio:

And known as being part of Lot Fifty-five (55) further bounded and described as follows, to wit:

Beginning at the intersection of the center line of the Kent-Mogadore Road with the South line of a 94.67 acre parcel of land conveyed to John Haldiman by deed recorded in Volume 333, Page 66 of Portage County Records, which intersection is South 16 deg. 30' West, a distance of 1638.00 feet from a monument at the North line of said Lot Fifty-five (55); thence South 88 deg. 29' West along the South line of said 94.67 acre parcel of land, a distance of 300.00 feet to a point; thence North 1 deg. 09' East, a distance of 247.27 feet to an iron fence post set in concrete; thence North 89 deg. 47' East, a distance of 113.30 feet to an iron pipe; thence South 79 deg. 20' East, a distance of 243.50 feet to a point in the center line of said Kent-Mogadore Road; thence South 16 deg. 30' West along the center line of said Kent-Mogadore Road, a distance of 103.00 feet the place of beginning and contains 1.72 acres of land, be the same more or less, but subject to all legal highways, as surveyed by W. S. Mathews in November, 1954.

And known as being a part of Lot 55, beginning at a point in the center line of the Kent-Mogadore Road, which point is the Northeast corner of a 1.72 acre parcel of land conveyed to Jack Thomas by deed recorded in Volume 586, Page 433, of Portage County Records and S. 16 deg. 30' W., a distance of 1435.00 feet from a monument at the North line of said Lot 55; thence S. 16 deg. 30' W., along the center line of said Kent-Mogadore Road, a distance of 103.00 feet to a point; thence N. 82 deg. 55' 30" W., a distance of 328.21 feet to an iron pipe in the West line of said 1.72 acre parcel of land; thence N. 1 deg. 09' E., along the West line of said 1.72 acre parcel of land, a distance of 103.00 feet to an iron fence post set in concrete at the Northwest corner of said 1.72 acre parcel of land; thence N. 89 deg. 47' E., along the North line of said 1.72 acre parcel of land, a distance of 113.30 feet to an iron pipe; thence S. 79 deg. 20' E., continuing along the North line of said 1.72 acre parcel of land, a distance of 243.50 feet to a place of beginning and contains 0.86 acre of land, be the same more or less, but subject to all legal highways, as surveyed by W. S. Mathews, in August 1958.

Beginning at the intersection of the centerline of C.H. 82-A (Old Forge Road) 60 ft. R/W and the centerline of C.H. 81-A (Mogadore Road) 60 ft. R/W; thence S. 16 deg. 23' 35" W., along the centerline of (C.H. 81-A) a distance of 1637.20 feet to a point and the true place of beginning; thence continuing S. 16 deg. 23' 35" W., along the centerline of (C.H. 81-A) a distance of 100.00 ft. to a point; thence S. 88 deg. 53' 35" W., a distance of 639.93 feet to an iron pipe; thence N. 0 deg. 48' 25" W., a distance of 95.37 feet to an iron pipe; thence N. 88 deg. 53' 35" E., a distance of 669.48 feet to a point on the centerline of C.H. 81-A and the true place of beginning. Said parcel of land contains 1.433 acres of land be it more or less, but subject to all legal highways, as surveyed by E. M. Scharenberrg, Registered Surveyor #4742 in May 1970.

TERMS OF SALE: Cash.

A deposit of 10% of your bid, cash or check, payable to the Portage County Sheriff is required at the time the bid is accepted. The balance of Purchase Price shall be paid within thirty (30) days after the date of sale.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
