In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 3rd Floor of the Courthouse, in the Hon. Laurie J. Pittman's Courtroom in Ravenna, in the above named County, on Monday, September 10, 2007, at 12:00 P.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Shalersville to-wit:

Being known as part of Original Lot No. 52, township, county and state aforesaid and more particularly described as follows:

Being known as the South 75.00 feet of Sublot No. 2, Shady Nook Allotment as recorded in Portage County Book of Plats, Plat Book 6, Page 48, measured at right angles to the South line of said Sublot No. 2.

And known as Sublot No. Three (3) of the Shady Nook Allotment of a part of Original Lots Nos. 52 and 69 of said Shalersville Township as the same are shown of record in Plat Book 6, Page 48 of Portage County Record. Excepting therefrom the following:

And in Section 52, Town 4N, Range 8W and Parcel No. 1-WD, lying on the left of the centerline of Infirmary Road and known as being a part of Sublot 2 of the Shady Nook Allotment as recorded in the Portage County Book of Plats, Plat Book 6 at Page 48 and being more fully bounded and described as follows:

Beginning at a bridge spike at the intersection of the centerline of Dudley Rd. (TH221A) and the tangent of a curve on the existing centerline of Infirmary Rd. (CR 164) said spike being the PI of the curve to the right which has a radius of 297.90 ft., central angle of 22 deg. 38' 40", a length of 117.55 feet, a chord length of 116.80 feet and a chord bearing of N. 06 deg. 37' 10" W., said point being 2.13 feet right of proposed centerline Sta. 18+96.00, as per plan on file at the County Engineer's Office, said plans being also the basis for the bearings of the description described hereafter; thence S. 17 deg. 55' 30" E., along the existing centerline tangent of Infirmary Road, a distance of 59.56 feet to a point, said point being radial to and 12.74 feet right of Infirmary Rd., proposed centerline Sta. 18+36.74; thence continuing S. 17 deg. 55' 30" E., along the existing centerline, a distance of 114.00 feet to a point, said point being at a right angle to and 19.92 feet right of Infirmary Road proposed centerline Sta. 17+21.33; thence continuing along the existing centerline of Infirmary Road on a curve to the right which has a radius of 903.08 feet, a central angle of 37 deg. 53' 30", an arc length of 597.24 feet; a chord length of 586.41 feet and a chord bearing on N. 01 deg. 01' 15" E., to a point said point being at Infirmary Road proposed centerline Sta. 11+27.00; thence S. 19 deg. 58' 00" W., continuing along said centerline a distance of 17.55 feet to a point at the Northeasterly corner of lands presently owned by John A. Clemens as recorded in the Portage County Records of Deeds, Volume 1093 at Page 341, said point being at Infirmary Rd., proposed centerline Sta. 11+09.45 and is the true place of beginning of the parcel of land herein described; thence continuing S. 19 deg. 58' 00" W., along the existing centerline a distance of 28.45 feet to a point on the existing right-of-way of Infirmary Road. Said point being at Infirmary Rd. proposed centerline Sta. 10+81.00; thence N. 70 deg. 02' 00" W., a distance of 20.00 feet to a point, said point being at right angle to and 20.00 feet left of Infirmary Rd. proposed centerline Sta. 10+81.00; thence N. 01 deg. 39' 01" E., a distance of 29.97 feet to a point on the North line of John A. Clemens lands, said point being at a right angle to and 29.42 feet left of Infirmary Rd., proposed centerline Sta. 11+09.45; thence S. 70 deg. 02' 00" E., along the North line of John A. Clemens, a distance of 29.42 feet to the place of beginning, which contains 703 square feet or 0.016 acre of which contains 703 square feet or 0.016 acre of which 569 square feet or 0.013 acre lies within the exiting right-of-way as surveyed by Carroll L. Hemmann, PS Ohio #5663, June 1993, 703 square feet or 0.016 acres of the above described area is out of Auditor's Parcel No. 33-052-20-00-030, which contains a total of 0.599 acres.

Said Premises Located at 10131 Infirmary Rd., Mantua, OH 44255.

Said Premises Appraised at $115,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid, cash or check, payable to the Portage County Sheriff is required at the time the bid is accepted. The balance of Purchase Price shall be paid within thirty (30) days after the date of sale.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
