Beginning at a railroad spike found at the S.E. corner of Lot 31 on the centerline of T.H. 73, Mahoning Road, S. 1-00-00 W., a distance of 2624.40 feet from a monument box at the N.E. corner of said Lot 31; thence N. 1-00-00 E., a distance of 288-31 feet along the East line of Lot 31 and centerline of T.H. 73 to an iron spike set which is the true place of beginning; thence N. 88-50-00 W., a distance of 780.72 feet to an iron rod set on the West line of this Grantor and passing over an iron rod set at 25.00 feet from said centerline; thence N. 1-00-00 E., a distance of 286.31 feet along the said West line of this Grantor to an iron rod set; thence S. 88-50-00 E., a distance of 760.72 feet to an iron spike set on the East line of Lot 31 and the centerline of T.H. 73; thence S. 1-00-00 W., a distance of 286.31 feet along the said lot line to the place of beginning and containing 5.000 acres of land as surveyed by Terrence R. Hohnhorst, Registered Professional Land Surveyor Number 5065 in April, 1987. The right of way above referred to is described as follows:
With the right to install underground electric distribution facilities upon the lands of Grantor, said undergroud electric facilites to be installed within an easement, said easement to be a ten (10.00) foot strip of land, five (5.00) feet on each side of a centerline, said centerline being more definitely described as follows:
Beginning at a point being the location of an existing overhead electric distribution pole, said pole being presently located within the Westerly half of Mahoning Road (T.T. -73-E), said pole being located one hundred and fourteen (114.00) feet Northerly of Grantors Southerly property line in common with the Northerly line of lands now or formerly owned by R.P. or D. M. Schneider, said pole being presently identified as 63AE/2-3; thence from this pole said centerline to be extended in a Southwesterly direction, a distance of thirty-five (35.00) feet to a point being located sixty-five (65.00) feet Northerly of Grantors Southerly property line; thence as deflecting to the right and extending said centerline in a Westerly direction along and parallel and being sixty-five (65.00) feet Northerly of Grantors Southerly property line, a distance of one hundred and seventy (170.00) feet to a point, said easement to include the installation of a pad mounted transformer in order to provide underground electric service thereon and thereto. The easement and rights herein granted shall include the right to erect, inspect, operate, replace, relocate, remove, repair, patrol and permanently maintain upon, over, under and along the above described right of way across said premises all necessary structures, wires, cables and other usual fixtures and appurtenances used for or in connection with the distribution of electric current including communication facilities, and the right of reasonable ingress and egress upon, over and across said premises for access to and from said right of way and the right to tri, cut, remove or control by any other means at any and all times such trees, limbs and underbrush within or adjacent to said right of way as may interfere with or endanger said structures, wires or appurtenances or their operation. Be the same more or less, but subject to all legal highways.
