In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 3rd Floor of the Courthouse, in the Hon. Laurie J. Pittman's Courtroom in Ravenna, in the above named County, on Monday, August 13, 2007, at 12:00 P.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Randolph to-wit:

Situated in the County of Portage, State of Ohio and in the Township of Randolph and known as being part of Lot 5 in said township and bounded and described as follows:

Beginning at a point in the Southerly line of Portage County, at the intersection of the Southwesterly corner of said Lot 5 and the centerline of S.R. 44, Ravenna-Louisville Road; thence N. 00 degrees 40' 00" E., along the Westerly line of Lot 5 and centerline of S.R. 44 a distance of 332.00 feet to a point at a Northwesterly corner of land now or formerly owned by Judy Ditirro (Vol. 1054, Pg. 597) which marks the true place of beginning for the following described parcel of land; thence continuing N. 00 degrees 40' 00" E., along the Westerly line of Lot 5 and centerline of S.R. 44 a distance of 260.24 feet to a point at the Southwesterly corner of land now or formerly owned by R. N. of I. M. Miller (Vol. 820, Pg. 143, passing over a 5/8" iron rod set at 30.00 feet) a distance of 264.63 feet to a 1/2" iron pipe found at a Southwesterly corner of land now or formerly owned by R. N. or I. M. Miller (Vol. 808, Pg. 130 & Vol. 998, Pg. 193) thence continuing N. 90 degrees 0' 00" along the Southerly line of said R. N. or I. M. Miller (Vol. 808, Pg. 130 & Vol. 998, Pg. 193) a distance of 591.67 feet to a 5/8" iron rod set; thence S. 00 degrees 50' 00" W., a distance of 250.24 feet to a 5/8" iron rod set; thence S. 90 degrees 0' 00" W., a distance of 496.05 feet to a 5/8" iron rod found in a Westerly line of the aforementioned Ditirro; thence S. 00 degrees 40' 00" W., a distance of 10.00 feet to a 5/8" iron rod found in a Northerly line of said Ditirro; thence S. 90 degrees 0' 00" W., along said Northerly line of Ditirro (passing over a 5/8" iron rod found at 330.00 feet, a distance of 360.00 feet to the true place of beginning. Containing, 5.000 acres of land, more or less, as surveyed August 21, 1989 by Al Szuch & Associates, Registered Professional Surveyor No. 5398.

Said Premises Located at 38 State Route 44, Hartville, OH.

Said Premises Appraised at $130,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid, cash or check, payable to the Portage County Sheriff is required at the time the bid is accepted. The balance of Purchase Price shall be paid within thirty (30) days after the date of sale.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
