In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 3rd Floor of the Courthouse, in the Hon. Laurie J. Pittman's Courtroom in Ravenna, in the above named County, on Monday, August 13, 2007, at 12:00 P.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Hiram to-wit:

Situated in the Township of Hiram, County of Portage and State of Ohio:

And known as being part of Lot No. 21, township, county and state aforesaid, and more particularly described as follows:

Beginning at an iron pin found at the centerline intersection of State Route No. 82 and Abbott Road (Highway No. 276-60' wide); this iron pin is situated in the South line of said Lot No. 21, North 88 degrees 40' West, a distance of 139.60 feet from the Southeast corner of said Lot No. 21; thence North 00 degrees 35' East, along the centerline of Abbott Road for a distance of 328.47 feet to an iron pin at the Southeast corner of 2.37 acre parcel of land now owned by George Herr; thence North 88 degrees 40' West, along the South side of said 2.37 acre parcel of land for a distance of 246.00 feet to an iron pin at the Southwest corner of said 2.37 acre parcel; thence North 00 degrees 35' East, along the West side of said 2.37 parcel of land for a distance of 419.13 feet to an iron pin at the Northwest corner of said 2.37 acre parcel of land; thence North 88 degrees 40' West along the South side of a 1.95 acre parcel of land now owned by Macaluso for a distance of 75.00 feet to an iron pin; thence 00 degrees 35' West (parallal with the centerline of Abbott Road) for a distance of 747.60 feet to a small iron pin in the South line of said Lot No. 21; thence South 88 degrees 40' East, along the South line of said Lot No. 21 and approximate centerline of State Route No. 82 for a distance of 321.00 feet to the place of beginning and found to contain 3.142 acres of land as surveyed by Lucius F. Converse, C.E., Registed Surveyor No. 1199 in November, 1971.

EXCEPTION PARCEL ONE:

Beginning at a point in the Southerly line of said Lot 21 at the intersection of the centerline of C.H. 276, Abbott Road and S.R. 82, Twinsburg-Warren Road; thence N. 89 degrees 39' 40" W., along the Southerly line of said Lot 21, a distance of 321.00 feet to a point at the Southeasterly corner of land now or formerly owned by Helen Vanderink (Vol. 758, Page 62); thence N. 00 degrees 28' 19" W., along the Easterly line of said Vanderink (passing over a 5/8" iron rod set at 33.00 feet) a distance of 328.74 feet to a 5/8" iron rod set; thence S. 89 degrees 29' 40" E. (passing over a 5/8" iron rod set at 291.00 feet) a distance of 321.00 feet to a point in the centerline of C.H. 276; thence S. 00 deg. 28' 19" E., along the centerline of C.H. 276, a distance of 328.47 feet to the place of beginning, containing 2.420 acres of land, more or less as surveyed June 23, 1986 by Al Sauch & Associates, Registered Surveyor No. 5398.

And known as being part of Lot No. 21, township, county and state aforesaid, and more particularly described as follows:

Beginning at an iron pin found at the centerline intersection of State Route No. 82 and Abbott Road (Highway No. 276-60' wide). This point is also in the South line of said Lot No. 21; thence North 00 degrees 35' East along the centerline of Abbott Road for a distance of 328.47 feet to an iron pin which marks the true place of beginning of the following described parcel of land; thence continuing along the centerline of Abbott Road, North 00 degrees 35' East, for a distance of 419.13 feet to an iron pin at the Southeast corner of a 1.959 acre parcel of land now owned by Robert Macula and recorded in Volume 462 at Page 103 of Portage County of Deeds; thence North 88 degrees 40' West along the South side of said Macaluso land for a distance of 246 feet to an iron pin; thence South 00 degrees 35' West for a distance of 419.13 feet to an iron pin; thence South 88 degrees 40' East for a distance of 246 feet to the true place of beginning and found to contain 2.367 acres of land as surveyed by Lucius F. Converse, No. 1199 in July 1958.

TERMS OF SALE: Cash.

A deposit of 10% of your bid, cash or check, payable to the Portage County Sheriff is required at the time the bid is accepted. The balance of Purchase Price shall be paid within thirty (30) days after the date of sale.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
