In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 3rd Floor of the Courthouse, in the Hon. Laurie J. Pittman's Courtroom in Ravenna, in the above named County, on Monday, July 16, 2007, at 12:00 P.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Randolph to-wit:

Situated in the Township of Randloph, County of Portage and State of Ohio:

Being a part of Lot 95 in Township 1 North, Range 8 West and being part of a 7.273 acre tract and a 4.490 acre tract conveyed to John Carl, Inc. by deeds as recorded by Instrument Number 200219245 and 200220966, respectively, of the Portage County Records and being more fully described as follows:

Beginning at a point in the West line of Lot 95, the East line of Lot 96 and State Route 44 (60' row), said point being located North 00 deg. 48 min. 13 sec. East, 824.81 feet from the centerline intersection of State Route 44 and Bassett Road (Township Highway 44-A) (60' row); thence from this "true place of beginning" and with said lot line and State Route 44, North 00 deg. 48 min. 13 sec. East, 150.00 feet to a point, said point being the Southwest corner of a 6.294 acre tract conveyed to Larry R. and Judith D. Wilcox (O.R. 364-144); thence leaving said road and lot line and with the South line of said 6.294 acre tract, South 89 deg. 40 min. 00 sec. East, 746.50 feet to an iron pin found at an interior corner of a 9.857 acre tract conveyed to T. Darrel and Rosemaria V. Brown (Instrument No. 200219244) and passing on line an iron pin found at 30.00 feet and 325.00 feet; thence leaving said South line and with the West line of said 9.857 acre tract, South 05 deg. 41 min. 25 sec. West, 150.65 feet to an iron pin set; thence leaving said West line and through the lands of the Grantor, North 89 deg. 40 min. 00 sec. West, 733.67 feet to the "true place of beginning" containing 2.549 acres of land, more or less, of which 0.103 acres is within the road right-of-way, 1.119 acres is out the 7.273 acre tract and 1.430 acres is out of the 4.490 acre tract and passing on line an iron pin set at 703.67 feet, but subject to all legal highways, right-of-ways, easements and lesses of record. Survey and description by Ronald L. Smith, Registered Surveyor No. 5324. Bearings were oriented to a survey dated June 8, 2002 by Ronald L. Smith, Reg. No. 5324. All iron pins set were 5/8" by 30" with a plastic cap stamped Ron Smith 5324.

Said Premises Located at 2670 State Route 14, Rootstown, OH 44272.

Said Premises Appraised at $150,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid, cash or check, payable to the Portage County Sheriff is required at the time the bid is accepted. The balance of Purchase Price shall be paid within thirty (30) days after the date of sale.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
