In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 3rd Floor of the Courthouse, in the Hon. Laurie J. Pittman's Courtroom in Ravenna, in the above named County, on Monday, July 2, 2007, at 12:00 P.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the City of Kent to-wit:

Situated in the City of Kent, County of Summit and State of Ohio:

PARCEL #1:

And further described as Lots 53, 59 and the North 22.5 feet of Lot #58, of Kent Rubber City Allotment No. 1, as the same is platted and recorded in Plat Book 3, Page 19, of the Portage County Records of Plats.

PARCEL #2:

Situated in the City of Kent, County of Portage and State of Ohio and known as being part of Franklin Township Lot 32 and further described as follows:

Beginning at an iron pipe at the Northeast corner of Sublot No. 35 of Kent Rubber City Addition No. 1 as recorded in Plat Book 3, Page 19 in the Portage County Records; thence N. 74 deg. 47' E., 65.61 feet along the Southerly line of Sublot No. 53 to a point in the West line of Sublot No. 59; thence S. 2 deg. 51' W., 44.66 feet along the Grantor's East line to a point in the West line of Sublot No. 58; thence S. 89 deg. 53' W., 62.46 feet to an iron pipe in the East line of Sublot No. 35; thence N. 2 deg. 51' E., 27.54 feet along the East line of Sublot No. 35 to the beginning. Containing 0.052 of an acre of land as surveyed in December 1975 by David J. Collier, Registered Surveyor No. 4819.

Situated in the City of Kent, County of Portage and State of Ohio and known as being a part of Franklin Township Lot 32 and further described as follows:

Beginning at a iron pin in the N.E. corner of Sublot 35 Kent Rubber City Addition N. 1 deg. as recorded (in) Plat Book 3, Page 19 in the Portage County Records; thence S. 2 deg. 51' W., a distance of 27.54' along the East line of Sublot 35 of said addition to an iron pin, which is the true place of beginning; thence W. 89 deg. 53' E., a distance of 62.46' along the Southerly line of property owned by D. Sours to an iron pin; thence S. 2 deg. 51' W., a distance of 15.00' along the West line of property owned by D. L. Mullins to an iron pin; thence S. 89 deg. 53' W., a distance of 62.46' through the property of the Grantor to an iron pin; thence N. 2 deg. 51' E., a distance of 15.00' along the East line of Sublot 35 of Kent Rubber City Addition #1 to the true place of beginning and containing 0.022 acres of land more or less as surveyed by Edward P. Wanchick, Registered Surveyor #5756.

Situated in the City of Kent, County of Portage and State of Ohio:

And known as being Lot No. 52 of Kent Rubber City Allotment No. 1, as platted, numbered and recorded in Plat Book 3, Page 19 of Portage County Records.

Property address is known as: 1036 Davey Avenue, Kent, OH

The title guaranty coverage under this Preliminary Judicial Report does not extend to the property address as the title examination which underwrites the coverage only covers the legal description of the real property.

Said Premises Located at 1036 Davey Avenue, Kent, OH 44240.

Said Premises Appraised at $135,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid, cash or check, payable to the Portage County Sheriff is required at the time the bid is accepted. The balance of Purchase Price shall be paid within thirty (30) days after the date of sale.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
