In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 3rd Floor of the Courthouse, in the Hon. Laurie J. Pittman's Courtroom in Ravenna, in the above named County, on Monday, May 14, 2007, at 12:00 P.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the City of Ravenna to-wit:

Located in Lot 46 of the South Division of lots in Ravenna Township, Portage County and being further described as follows:

Beginning at a monument located at the intersection of the centerline of C.H. 171 (Cleveland Road) and the centerline of C.H. 163 (Lovers Lane); thence S. 87 deg. 23' W., a distance of 1848.70 feet along the centerline of Lovers Lane to the East side of a 14 foot lane now owned by Felix and C. Giulitto; thence S. 0 deg. 35' 30" E., a distance of 1054.53 feet along the East side of said 14 foot lane to an iron pipe; thence S. 86 deg. 48' 30" E., a distance of 3.00 feet to an iron pipe which is the true place of beginning; thence continuing S. 86 deg. 48' 30" E., a distance of 769.44 feet to the West line of land now or formerly owned by L. and G. Kunar and passing over an iron pipe 560.67 feet from the place of beginning; thence S. 4 deg. 26' 30" W., a distance of 145.35 feet to an iron pipe at the Southwest corner of said Kunar property; thence S. 73 deg. 50' 30" E., a distance of 61.93 feet to an iron pipe; thence S. 40 deg. 41' W., a distance of 440.15 feet to an iron pipe; thence S. 56 deg. 48' E., a distance of 92.90 feet to an iron pipe; thence S. 16 deg. 55' W., a distance of 250.20 feet to the South line of Lot 46 and the centerline of county ditch, passing over an iron pipe 10.46 feet from said centerline; thence S. 89 deg. 50' W., a distance of 526.47 feet along the South line of Lot 46 and the centerline of the county ditch to the Southeast corner of land now or formerly owned by Felix and C. Giulitto; thence N. 0 deg. 35' 30" W., a distance of 832.05 feet along the East line of said Giulitto property to the place of beginning, passing over an iron pipe 10.61 and 781.08 feet from the centerline of the county ditch and containing 12.12 acres of land, as surveyed by A. Kenneth Boydell, Registered Surveyor No. 4434. There is hereby granted to the Grantees, their heir and assigns, a permanent easement for ingress and egress to the above describd premises across the following described premises, which is to be used by the Grantees, their heirs and assigns jointly with the Grantors, their heirs and assigns. Grantors reserve the right to include said easement as a part of their premises to be dedicated as a public street or road. As being part of Lot 46 of the South Division of lots in said township and more particularly described as follows:

Beginning at a monument located at the intersection of the C.H. 171 (Cleveland Road) and the centerline of C.H. 163 (Lovers Lane); thence S. 87 deg. 23' W., a distance of 1251.76 feet along the centerline of Lovers Land to the true place of beginning of a 16 foot wide easement of access; thence S. 1 deg. 01' 30" E., a distance of 635.40 feet along the centerline of said 16 foot easement to a point; thence S. 5 deg. 31' 30" W., a distance of 264.20 feet along the centerline of said 16 foot easement to a point; thence S. 3 deg. 30' 30" W., a distance of 213.98 feet to a point on the North line of the previously described 12.12 acre tract, said point is S. 86 deg. 48' 30" E., a distance of 568.67 feet from the true place of beginning of said 12.12 acre tract as surveyed by A. Kenneth Boydell, Registered Surveyor No. 4434. The Grantees their heirs and assigns are also permitted the right to use the driveway now located on the premises of the Grantors running from the highway to the above conveyed premises as a temporary means of ingress and egress to the conveyed premises. This temporary easement shall continue for an indefinite period of time and shall be extinguished only by a written ninety (90) day notice from the Grantors to the Grantees or by disconnection used thereof by the Grantees for a perion of six (6) months, be the same more or less, but subject to all legal highways.

TERMS OF SALE: Cash.

A deposit of 10% of your bid, cash or check, payable to the Portage County Sheriff is required at the time the bid is accepted. The balance of Purchase Price shall be paid within thirty (30) days after the date of sale.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
