In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 3rd Floor of the Courthouse, in the Hon. Laurie J. Pittman's Courtroom in Ravenna, in the above named County, on Monday, April 16, 2007, at 12:00 P.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Edinburg to-wit:

Situated in the Township of Edinburg, County of Portage and State of Ohio:

FIRST TRACT:

Known as being a tract of land located in Subdivision 1 of Lot 7, N.E. and further described as follows:

Beginning at a point being the principal place of beginning for the following description, set in the West line of said Subdivision 1 and in the centerline of the Edinburg-Charlestown Road at the Southwest corner of the property of J. J. and K. S. Ward, being N. 0 deg. 45' E., 2549.23 feet from an iron bolt in the center of the Tallmadge Road (C.H. 18); thence S. 87 deg. 40' E., 809.82 feet to an iron pipe set in the West line of lands now owned by W. H. and L. G. Perkins and passing over an iron pipe set 30.00 feet from the centerline of the road; thence S. 0 deg. 45' W., 75.00 feet along the West property line of W. H. and L. C. Perkins to an iron pipe; thence N. 87140' W., 809.82 feet to the centerline of the road and passing over an iron pipe set 30.00 feet therefrom; thence N. 0 deg. 45' E., 75.00 feet along the centerline of the road to the principal place of beginning and containing 1.39 acres of land.

Situated in the township, county and state aforesaid and known as being Sublot 13 of Esther B. Dunlavy Allotment Subdivision No. 1, as the same is platted, numbered and recorded in Vol. 9, Page 22, Portage County Record of Plats. Now known as Rock Spring Road, C.H. 52.

Situated in the Township of Edinburg, County of Portage and State of Ohio:

Situated in the township, county, and state above mentioned and known as being part of Subdivision No. 1 of large Lot No. 7 in the North East quarter of said township, described as follows:

Beginning in the South line of said lot 809.82 ft. East from the South West corner of said lot; thence North 2482.14 feet to the South line of land of G. Montz; thence East along the South line of said Montz's land, to the land of D. & M. Davis, being the East line of said subdivision; thence South 1605.78 feet along the West line of said Davis land to the North line of land of Bishop, to a point; thence West 128 feet to a point; thence South 880.44 feet to the South line of said lot; thence West 227.70 feet to the place of beginning and containing twenty and sixty three hundredths (20.63) acres of land. EXCEPTING THEREFROM THE FOLLOWING DESCRIBED PREMISES:

Beginning on the West line of Lot 7 N.E. Sub. Div. 1 of Edinburg Township 30.00 feet North of a nail at the intersection of the centerline of C.H. 52, known as the Rock Spring Road and County Highway No. 18, Tallmadge Road; thence South 88 deg. 11' East, along the North line of the Tallmadge Road, a distance of 811.76 feet to its intersection with the Easterly property line of L. & M. West, which is the True Place of Beginning for this description; thence North 0 deg. 54' East along the Easterly side of the West property, a distance of 902.20 feet to an iron pin at the Southeast corner of the E. S. Dunlavy Allotment as shown in the Portage County Records in Vol. 9, Page 22, Plat Book; thence North 0 deg. 45' East along the Easterly side of said allotment, a distance of 1266.27 feet to an iron pipe on the South line of right of way for Interstate 80; thence South 89 deg. 56' 54" East, along the South right of way line of I. S. 80, a distance of 440.57 feet to an iron pipe on the Westerly property line of D. & M. Davis; thence South 2 deg. 45' 30" West along the West line of the Davis property, a distance of 1298.07 feet to an iron pipe at the Northeast corner of the A. & T. Bishop property; thence North 88 deg. 11' West along the North line of the Bishop property, a distance of 128.00 feet to an iron pipe; thence South 3 deg. 59' 30" West along the West line of the Bishop property, a distance of 880.44 feet to an iron pipe on the North right of way line of C.H. 18, the Tallmadge Road; thence North 80 deg. 11' West along the North right of way line of C.H. 18, a distance of 219.75 feet to the Southeast corner of the L. & M. West property at the true place of beginning and containing 17.309 acres of land, as surveyed in September of 1971 of Thomas E. James, Registered Surveyor No. 1431 of the State of Ohio.

Said Premises Located at 4302 Rock Springs Road, Ravenna, OH 44266.

Said Premises Appraised at $130,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid, cash or check, payable to the Portage County Sheriff is required at the time the bid is accepted. The balance of Purchase Price shall be paid within thirty (30) days after the date of sale.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
