In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 3rd Floor of the Courthouse, in the Hon. Laurie J. Pittman's Courtroom in Ravenna, in the above named County, on Monday, March 26, 2007, at 12:00 P.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Edinburg to-wit:

Situated in the Township of Edinburg, County of Portage and State of Ohio:

And known as being the North-West part of Lot No. Two (2) in the North-West quarter of said township and being bounded as follows:

Commencing at the North West corner of said lot; thence East on the North line 89 deg. 50' East, 18 chains 25 links; thence Southeasterly along land formerly owned by Theodore Clark to a post; thence West to the highway; thence North on the center of the highway to the place of beginning. The South line to be parallel with the North line and so far distant therefrom as to contain twelve (12) acres of land, and being the same premises conveyed to H. W. John by warranty deed from Anna S. Crocker, widow by deed dated March 8th, 1919 as the same is recorded in Volume 245, Page 518 of the deed records of Portage County, Ohio, be the same more or less, but subject to all legal highways.

Excepting therefrom the following described premises:

EXCEPTION #1:

And known as being a tract of land located in Lot 2, Edinburg Township, Portage County, Ohio and further described as follows:

Beginning at the Northwest corner of said Lot 2 and the Southwest corner of the T. H. Bailey property and the center of County Highway No. 47 aka Campbellsport-Industry South Road; thence South 1 deg. 0' West along said road center line 125.00 feet to a point; thence South 78 deg. 58' East and passing over an iron pipe set 30.00 feet at side of road, 202.00 feet to an iron pipe set in center of ditch; thence North 1 deg. 0' East, 125.00 feet to an iron pipe set in T. H. Bailey's South property line; thence North 87 deg. 58' West along said Bailey property line, and passing over an iron pipe set 30.00 feet at side of road, 202.00 feet to center of county road, being the place of beginning and containing .579 acres of land. Be the same more or less, but subject to all legal highways. Surveyed by C. B. Dodge and W. D. Moulton.

EXCEPTION #2:

Situated in the Township of Edinburg, County of Portage and State of Ohio, and known as being a tract of land located in Lot No. 2 Edinburg Township Portage County, Ohio and further bounded and described as follows:

Beginning at a point in the Northwest corner of said Lot No. 2 and the Southwest corner of T. H. Bailey property and the centerline of County Highway No. 47 aka Campbellsport-Industry South Road; thence South 1 deg. 0' West along the centerline of said road 125.0 feet to a point which is the true place of beginning of this parcel; thence South 87 deg. 58' East and passing over an iron pipe set 30.00 feet at the side of the road 202.0 feet to an iron pipe, said pipes being set by C. B. Dodge and W. B. Moulton as described in Volume 508, Page 373; thence South 1 deg. 0' West, 125 feet to an iron pin set; thence North 87 deg. 58' West and passing over an iron pin set 30.0 feet at the said road 202.0 feet to a point on the center line of said road; thence North 1 deg. 0' East along the centerline of said road 125.0 feet to the true place of beginning and containing therein 0.579 acres of land, be the same more or less, but subject to all legal highways, as surveyed by Rees H. Engelhardt No. 3417.

EXCEPTION #3:

Situated in the Township of Edinburg, County of Portage and State of Ohio:

And known as being a part of Lot 2, Northwest quarter of said township and further described as follows:

Beginning at a point in the center of Industry Road at the North West corner of Lot 2; thence S. 87 deg. 58' E., a distance of 202.00 feet along the North line of Lot 2 to an I.P. in the N.E. corner of property owned by Jack and Mary French, which is the true place of beginning; thence continuing S. 87 deg. 58' E., a distance 522.72 feet along the North line of Lot 2 to an I.P.; thence S. 1 deg. 00' W., a distance of 125.00 feet through the property of the Grantor to an I.P.; thence N. 87 deg. 58' W., a distance of 522.72 feet through the property of the Grantor to an I.P. in the S.E. corner of property owned by Jack and Mary French; thence N. 1 deg. 00' E., a distance of 125.00 feet along the East line of said French to the true place of beginning and containing 1.50 acre of land, more or less, as surveyed by Edward P. Wanchick, Registered Surveyor No. 5756.

EXCEPTION #4:

Situated in the Township of Edinburg, County of Portage and State of Ohio:

And known as being part of Lot 2 in the Northwest quarter of Edinburg Township and further described as follows:

Commencing at the Northwest corner of Industry Road; thence S. 1 deg. 00' W., 125.00 feet along the centerline of Industry Road to the Grantee's Northwest corner; thence S. 87 deg. 58' E., 202.00 feet to an iron pipe at the Grantees Northeast corner and being the true place of beginning; thence S. 87 deg. 58' E., 522.72 feet along the South line of land owned by J. L. French (D.V. 1160, Pg. 31) to an iron pipe at French's Southeast corner; thence S. 1 deg. 00' W., 125.00 feet to an iron pipe set; thence N. 87 deg. 58' W., 522.72 feet to an iron pipe at the Grantee's Southeast corner; thence N. 1 deg. 00' E., 125.00 feet along the Grantee's East line to the true place of beginning. Containing 1.500 acres of land, be the same more or less, as surveyed in March, 1998 by Edward J. Collier, Registered Surveyor No. 7141.

Said Premises Located at 4998 Industry Rd., Ravenna, OH 44266.

Said Premises Appraised at $150,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid, cash or check, payable to the Portage County Sheriff is required at the time the bid is accepted. The balance of Purchase Price shall be paid within thirty (30) days after the date of sale.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
