In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 3rd Floor of the Courthouse, in the Hon. Laurie J. Pittman's Courtroom in Ravenna, in the above named County, on Monday, March 12, 2007, at 12:00 P.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Village of Garrettsville to-wit:

Situated in the Village of Garrettsville, County of Portage and State of Ohio:

PARCEL NO. 1:

Being a part of Original Surveyed Lot No. 1 in Nelson Township before the Organization of Garrettsville and is more particularly known as being part of Village Lot No. 35 in Garrettsville aforesaid, according to J. Cole's survey made A.D. 1870, recorded in Volume 2, Page 7, Portage County Plat Records. The plat of said Lot No. 35 hereby conveyed is bounded on the East, South and West by lot lines of said Lot No. 35 and on the North by a straight line drawn from the East line to the West line thereof the point on the point on the East line of Liberty Street is drawn is 133 feet North of the Southeast corner of said Lot No. 35 and the point on the West line of said lot to which said straight line is drawn is 120 & 7/12 feet North of the Southwest corner of said Lot No. 35. Said Lot No. 35 is at the Northwest corner of Liberty Street and Park Avenue, in the Village of Garrettsville.

EXCEPTING THEREFROM:

Situated in the Village of Garrettsville, County of Portage and State of Ohio, and known as being a part of Lot 1, in Nelson Township before the Organization of Garrettsville, and more particularly known as being a part of Lot No. 35 in J. Cole's Survey of Garrettsville, beginning at an iron pin set to mark the intersection of the Northerly line of Park Avenue, and the Easterly line of Liberty Street; thence North 16 degrees West along the Easterly line of Liberty Street 133 feet to an iron pin; thence South 74 degrees 53' West along the Northerly line of land owned by J. T. and E. B. Campbell 76.8 feet to an iron pipe; thence South 15" 37' East, 127.4 feet to an iron pipe in the Northerly line of Park Avenue; thence North 78" 49' East, along the Northerly line of Park Avenue, 81.5 feet to the place of beginning, be the same more or less, but subject to all legal highways.

PARCEL NO. 2:

Situated in the Village of Garrettsville, County of Portage and State of Ohio:

Known as being part of Original Lot No. 1 in Nelson Township, Portage County and State of Ohio, and is more particularly known as being a part of Lot No. 35 in large Lot No. 1 as surveyed by J. Cole, County Surveyor A.D. 1870 as shown in Volume 2, Page 7 of Portage County Plat Records. The part of said Village Lot No. 35 hereby conveyed is the North part hereof, and all of said lot not heretofore conveyed to Meda Foster and is bounded North, East and West by the lines of said Lot No. 35 and South by a straight line drawn from a point in the East line of said lot, 133 feet from the Southeast corner thereof, to the West line of said lot, at a point 120 7/12 feet from the Southwest corner thereof, be the same more or less, but subject to all legal highways.

EXCEPTING THEREFROM:

Situated in the Village of Garrettsville, County of Portage and State of Ohio:

Known as being part of Original Nelson Township Lot 1 before the Organization of Garrettsville and further known as being part of Lot No. 35 in J. Cole's Survey of Garrettsville and further described as follows:

Beginning at an iron pin set to mark the intersection of the Northerly line of Park Avenue and the Westerly line of Liberty Street; thence North 16" 00' West, along the Westwardly line of Liberty Street for a distance of 133.00 feet to an iron pin which marks the true place of beginning of the following described parcel of land; thence continuing along the Westwardly line of Liberty Street North 16" 00' West, for a distance of 105.00 feet to the South edge of the water line of Camp Creek; thence North 86" 58' West, along the South line of Camp Creek for a distance of 80.31 feet to a point in the West line of property now standing in the name of J. T. and E. B. Campbell; thence South 15 degrees 37' East for a distance of 130.00 feet to the Northwest corner of a parcel of land now standing in the name of Bruce and recorded in Volume No. 831, Page No. 481 and 483 of Portage County Record of Deeds; thence North 74 degrees 53' East along the North side of said Bruce property for a distance of 76.80 feet to the true place of beginning and found to contain 0.206 acres of land as surveyed by Lucius F. Converse C.E., Registered Surveyor No. 1199 in September 1971.

Said Premises Appraised at $140,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid, cash or check, payable to the Portage County Sheriff is required at the time the bid is accepted. The balance of Purchase Price shall be paid within thirty (30) days after the date of sale.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
