In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 3rd Floor of the Courthouse, in the Hon. Laurie J. Pittman's Courtroom in Ravenna, in the above named County, on Monday, February 26, 2007, at 12:00 P.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Deerfield to-wit:

The following described premises situated in the Township of Deerfield, County of Portage and State of Ohio:

PARCEL IV:

Subdividing a 3.9436 acre parcel from property belonging to Roger Thomas, as recorded in Deed Vol. 58, Page 189 and a 2.2390 acre parcel from property belonging to Roger Thomas, as recorded in Deed Vol. 58, Page 191 of the Portage County Records and combining these to form a 6.1826 acre parcel situated in the Township of Deerfield, County of Portage, State of Ohio and also, known as being part of Lots 86 & 85 of said township and being further bounded and described as follows:

Commencing at the intersection of the centerline of Wayland Road (60' wide) and Cleveland-East Liverpool Road (S.R. 14 & S.H. 14) (66' wide); thence South 46 deg. 03' 10" West, along the centerline of Cleveland-East Liverpool Road, 806.11 feet to the "True Place of Beginning" of the parcel herein described; thence North 59 deg. 23' 43" East, 1400.70 feet, passing through a 5/8" rebar with ID cap "Bock & Clark" set at 34.24 feet, to a 5/8" rebar with ID cap "Bock & Clark" set; thence South 00 deg. 18' 39" East, along the West line of a parcel now or formerly owned by G. A. or S. M. Welker as recorded in Deed Vol. 1077, Page 54, of the Portage County Records, 305.00 feet to a 5/8" rebar with ID cap "Bock & Clark" set; thence South 65 deg. 00' 57" West, 1212.72 feet, passing through a 5/8" rebar with ID cap "Bock and Clark" set at 1177.36 feet, to a point in the centerline of Cleveland-East Liverpool Rd.; thence North 46 deg. 03' 10" West, along the centerline of Cleveland-East Liverpool Rd., 150.00 feet to the "True Place of Beginning" and containing 6.1826 acres of land, more or less, of which 0.8838 acres are in Lot 85 and 5.2988 acres are in Lot 86, as calculated by the above courses by Ted R. Clark, Ohio Registered Surveyor No. 6809, for an on behalf of Bock & Clark, under Project No. 95495. The property is conveyed with all rights, privileges and appurtenances and subject to all easements, encroachments, restrictions and reservations as of record may appear.

Said Premises Appraised at $145,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid, cash or check, payable to the Portage County Sheriff is required at the time the bid is accepted. The balance of Purchase Price shall be paid within thirty (30) days after the date of sale.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
