In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 3rd Floor of the Courthouse, in the Hon. Laurie J. Pittman's Courtroom in Ravenna, in the above named County, on Monday, January 8, 2007, at 12:00 P.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Randolph to-wit:

Being part of Lot 56 in said township, beginning for commencement at the Southeast corner of Lot 56; thence N. 00 deg. 50' 00" E., along the centerline of St. Rt. 44, a distance of 1134.93 feet to a point in the centerline of said road, and the true place of beginning for the property herein described. Said property owned by R. and L. K. Beale, Deed Volume 1006, Page 342; thence turning N. 88 deg. 35' 00" W., along the South property line of R. and L. K. Beale, Deed Volume 1006, Page 342, a distance of 247.50 feet East to a point; thence turning S. 00 deg. 50' 00" W., along the East property line of R. and L. K. Beale, Deed Volume 1006, Page 342, a distance of 85.80 feet to a point; thence turning N. 88 deg. 35' 00" W., along the South property line of R. and L. K. Beale, Deed Volume 1006, Page 342, a distance of 172.92 feet to a point; thence turning S. 00 deg. 50' 00" W., along the East property line of M. Huth, Deed Volume 1025, Page 003, a distance of 145.20 feet to a point; thence turning S. 88 deg. 35' 00" E., along the North property line of S. L. and M. N. Wise, Deed Volume 622, Page 567, a distance of 420.42 feet to a point in the centerline of St. Rt. 44; thence turning N. 00 deg. 50' 00" E., along the centerline of St. Rt. 44, a distance of 221.00 feet back to the true place of beginning. Containing 1,8888 acres of land, more or less, excepting all legal highways and easements of record. Surveyed by Terrence L. Pearson, P.S. #9305 in May of 2001. The basis of bearing (N. 00 deg. 50' 00" E.) was taken from Deed Volume 1006, Page 342.

Being part of Lot 56 in said township, beginning for commencement at the Southeast corner of Lot 56; thence N. 00 deg. 50' 00" E., along the centerline of St. Rt. 44, a distance of 1134.93 feet to a point in the centerline of said road, and the true place of beginning for the property herein described. Said property owned by R. and L. K. Beale, Deed Volume 1006, Page 342; thence N. 00 deg. 50' 00" E., continuing along the centerline of St. Rt. 44, a distance of 15.00 feet to a point in the centerline of said road; thence turning N. 88 deg. 35' 00" W., along the South property line of R. G. Hershberger, a distance of 359.50 feet to a point; thence turning S. 00 deg. 50' 00" W., along the East property line of M. Huth, Deed Volume 1025, Page 003, a distance of 100.80 feet to a point; thence turning S. 88 deg. 35' 00" E., along the North property line of R. and L. K. Beale, Deed Volume 1006, Page 342, a distance of 112.00 feet to a point; thence turning N. 00 deg. 50' 00" E., along the West property line of R. and L. K. Beale, Deed Volume 1006, Page 342, a distance of 85.80 feet to a point; thence turning S. 88 deg. 35' 00" E., along the North property line of R. and L. K. Beale, Deed Volume 1006, Page 342, a distance of 247.50 feet back to the true place of beginning. Containing 0.3444 acres, more or less and excepting all legal highways and easements of record. Surveyed by Terrance L. Pearson, P.S. #9305 in May 2001. The basis of bearing (N. 00 deg. 50' 00" E.) was taken from Deed Volume 1006, Page 342.

Said Premises Located at 1477 State Route 44, Randolph, OH 44241.

Said Premises Appraised at $200,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid, cash or check, payable to the Portage County Sheriff is required at the time the bid is accepted. The balance of Purchase Price shall be paid within thirty (30) days after the date of sale.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
