In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 3rd Floor of the Courthouse, in the Hon. Laurie J. Pittman's Courtroom in Ravenna, in the above named County, on Monday, January 8, 2007, at 12:00 P.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Edinburg to-wit:

Situated in the Township of Edinburg, County of Portage, State of Ohio, and being part of Lot No. 9, Northeast, Subdivision 2 in said township, and known as being all of the land conveyed to Lucille Boothe as recorded in Volume 889, Page 679 of the Portage County Records of Deeds and more particularly described as follows:

Commencing from a point in the centerline of Tallmadge Road, also known as State Route No. 18, a 60 foot wide public right of way, and being at the Southwest corner of Lot No. 9, Northeast, Subdivision 2; thence along the centerline of said Tallmadge Road, South 89 deg. 39' 26" East, 552.71 feet to the Southeast corner of a parcel of land now or formerly owned by R. J. Stumphf as recorded in Volume 20, Page 984 of the Portage County Records of Deeds, and being the place of beginning for the parcel of land described herein; thence along the East line of said Stumphf parcel of land, North 02 deg. 09' 11" West, passing a 1" iron pipe found at a distance of 30.32 feet, a total distance of 360.34 feet to an iron pin set, said point being the Southwest corner of a parcel of land now or formerly owned by R. N. MacGregor as recorded in Volume 1063, Page 808 of the Portage County Records of Deeds; thence along the South line of said MacGregor parcel of land, South 89 deg. 39' 26" East, 132.00 feet to an iron pin set at the Northwest corner of a parcel of land now or formerly owned by R. O. & A. M. Driscoll as recorded in Volume 1016, Page 888 of the Portage County Records of Deeds; thence along the West line of said Driscoll parcel of land, South 02 deg. 09' 11" East, passing over an iron pin set a distance of 330.31 feet, a total distance of 360.34 feet to the centerline of said Tallmadge Road; thence along the centerline of said Tallmadge Road, North 89 deg. 39' 26" West, 132.00 feet to the place of beginning and containing 1.0909 acres (47,520 square feet) of land, more or less, as determined by Timothy R. Durr, Registered Professional Land Surveyor No. S-7788, from a survey made in October of 1999 for and on behalf of Millman Surveying, Inc., but subject to any easements, restrictions, or reservations of legal record that may pertain to this parcel of land described herein. The basis of bearings for all bearings described herein is the East line of the R. J. Stumphf parcel of land, said line being the West line of the premises described herein, as being North 02 deg. 09' 11" West as described in Volume 20, Page 684 of the Portage County Records of Deeds and as shown on a survey made by Rob A. Szuch, dated November 30, 1995 and filed as Surveyor No. P-11210 of the Portage County Records of Surveys. All iron pins set are 1/2" rebar, 30" long, with a yellow I.D. Cap stamped "Millman".

A deposit of 10% of your bid, cash or check, payable to the Portage County Sheriff is required at the time the bid is accepted. The balance of Purchase Price shall be paid within thirty (30) days after the date of sale.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
