In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 3rd Floor of the Courthouse, in the Hon. Laurie J. Pittman's Courtroom in Ravenna, in the above named County, on Monday, January 8, 2007, at 12:00 P.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Charlestown to-wit:

And known as being a part of Lots 23 and 32 of said township and further described as follows:

Beginning at the centerline intersection of Rock Spring Road, C.H. 52, and the construction centerline of SR #5; thence N. 81 degrees 08' 30" E., a distance of 2223.21' along the construction centerline to a point which is the true place of beginning; thence N. 0 degrees 17' 30" E., a distance of 655.14' along the Easterly line of a 3.61 degrees acre tract to an I.P. and passing over an I.P. at 114.46'; thence S. 89 degrees 34' 37" E., a distance of 231.04' along the Southerly lines of property owned by H. or K. L. Armentrout and C. A. Davidson to an I.P.; thence S. 0 degrees 17' 30" W., a distance of 620.81' along the Westerly line of property owned by A. E. & B. M. White and long the Westerly line of a 2.749 acre tract to a point in the construction centerline of SR #5, and passing over an I.P. 114.46' back from said centerline; thence S. 81 degrees 08' 30" W., a distance of 234.00' along the said centerline to the true place of beginning and containing 3.437 acres of land more or less of which 2.807 acres in Lot 32 and 0.630 acres in Lot 23, as surveyed by Edward P. Wanchick, R.S. No. 5756. The above described parcel is subject to the following deed restrictions:

1.) All driveways must have turn around so you do not back onto SR 5.

2.) All said dwellings must set back from the state right of way at least 100 feet.

3.) This parcel shall be known as residential parcel and no business of any kind, either directly or indirecly shall be conducted on said parcel of land.

Be the same more or less, but subject to all legal highways.

Said Premises Appraised at $85,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid, cash or check, payable to the Portage County Sheriff is required at the time the bid is accepted. The balance of Purchase Price shall be paid within thirty (30) days after the date of sale.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
