In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 3rd Floor of the Courthouse, in the Hon. Laurie J. Pittman's Courtroom in Ravenna, in the above named County, on Monday, December 18, 2006, at 12:00 P.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Randolph to-wit:

Situated in the State of Ohio, County of Portage and Township of Randolph and being further described as follows:

TRACT 1:

And known as being a part of Lot 66 in said Randolph Township, and bounded and described as follows:

Beginning at a point in the South line of said Lot 66 at the Southeast corner of a 15.00 acre parcel of land formerly owned by Charles P. and Gertrude Gardner, now owned by Coy E. and Alberta M. Yerkey, said beginning point being South 89 deg. 51' E., a distance of 608.30 feet from the Southwest corner of said Lot 66; thence N. 0 deg. 04' E., parallel to the West line of said Lot 66, a distance of 241.00 feet to a point; thence S. 89 deg. 51' E., parallel to the South line Lot 66 a distance of 75.00 feet to a point; thence S. 0 deg. 04' West, parallel to the West line of said Lot 66, a distance of 241.00 feet to a point in the South line of said Lot 66; thence N. 89 deg. 51' W., along the South line of said Lot 66, a distance of 75.00 feet to the place of beginning and containing as surveyed by Donald H. Matthews, in April 1954, 0.415 acres of land. Be the same more or less, but subject to all legal highways.

Beginning at a point at the intersection of the Southwesterly corner of Lot 66 and centerline of C.H. 87, Waterloo Road; thence South 89 deg. 10' 00" E., along the Southerly line of Lot 66 and centerline of C.H. 87, a distance of 683.30 feet to a point at the Southeasterly corner of land now or formerly owned by W. E. and A. A. Mason (Volume 974, Page 314); thence North 00 deg. 33' 42" East, a distance of 241.00 feet to a 5/8" iron rod set at the Northeasterly corner of said Mason which marks the true place of beginning for the following described parcel of land; thence North 89 deg. 10' 00" West along the Northerly line of said Mason, a distance of 75.00 feet to a 5/8" iron rod set in the Easterly line of land now or formerly owned by J. D. or P. A. Sombati (Volume 981, Page 491); thence N. 00 deg. 33' 42" East along Sombati's Easterly line a distance of 30.00 feet to a 5/8" iron rod set; thence S. 89 deg. 10' 00" E., a distance of 75.00 feet to a 5/8" iron rod set; thence S. 00 deg. 33' 42" W., a distance of 30.00 feet to the true place of beginning, containing 0.052 acre of land. Be the same more or less, but subject to all legal highways.

A deposit of 10% of your bid, cash or check, payable to the Portage County Sheriff is required at the time the bid is accepted. The balance of Purchase Price shall be paid within thirty (30) days after the date of sale.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
