In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 3rd Floor of the Courthouse, in the Hon. Laurie J. Pittman's Courtroom in Ravenna, in the above named County, on Monday, December 18, 2006, at 12:00 P.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Rootstown to-wit:

And known as being part of Lot 37 in Rootstown Township and further described as follows:

Beginning at a point in the centerline of Saxe Road and the South line of Lot 37 and being S. 89 degrees 45' 26" E., 1386.95 feet from an iron bar at the Southwest corner of Lot 37; thence N. 0 degrees 51' W., 1033.32 feet to the Grantor's North line and passing over an iron pipe 30.00 feet therefrom and an iron pipe 30.00 feet from the road center; thence S. 89 degrees 59' 15" E., 160.00 feet to an iron pipe at the Grantor's Northeast corner; thence S. 0 degrees 51' E., 784.64 feet along the Grantor's East line to the Northeast corner of D. & I. Cheuvront; thence N. 89 degrees 59' 15" W., 100.00 feet to Cheuvront's Northwest corner; thence S. 0 degrees 51' E., 248.94 feet along Cheuvront's West line to the centerline of Saxe Road and the South line of Lot 37; thence N. 89 degrees 45' 26" W., 60.00 feet along the centerline of Saxe Road and the South line of Lot 37 to the beginning. Containing 3.224 acres of land, be the same more or less, but subject to all legal highways, as surveyed in January, 1993 by Edward J. Collier, Registered Surveyor No. 7141.

Said Premises Located at 3053 Saxe Rd., Mogadore, OH 44260.

Said Premises Appraised at $115,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid, cash or check, payable to the Portage County Sheriff is required at the time the bid is accepted. The balance of Purchase Price shall be paid within thirty (30) days after the date of sale.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
